According to the new regulations, when issuing the Certificate, it will no longer list the name of the “household” but only the name of the representative or individuals sharing land use rights. Therefore, when processing the Certificate renewal, the members of Mr. Nguyen Van A’s household agreed to have Mr. C and Mr. D as representatives.

Based on Clause 4, Article 256 of the 2024 Land Law, the renewal of the Certificate for household members sharing land use rights is subject to mutual agreement among the members, who are responsible before the law.

This regulation does not require a document from a competent authority confirming the number of household members at the time of land allocation, lease, or recognition of land use rights.

Ms. Thanh Tuyen (Dong Thap) asks whether changing the representative on the Certificate requires a written agreement among household members confirmed by a competent authority, or if the registration form for changes should reflect that Mr. C and Mr. D represent the other members.

In the case of the aforementioned Certificate, can each household member be issued a separate Certificate if requested?

The Ministry of Agriculture and Environment responds as follows:

The issuance of Certificates for land plots owned by households is governed by Clause 5, Article 135 of the 2024 Land Law, which stipulates the issuance of a single Certificate listing all household members sharing land use rights.

Determining household members sharing land use rights for inclusion on the Certificate is based on mutual agreement among these members, who are responsible before the law. This includes changes to the representative on the Certificate, without requiring confirmation from a competent authority.

Point a, Clause 2, Section VII, Content C, Part V of Appendix 1, issued with Decree No. 151/2025/NĐ-CP, states that for Certificate renewals to include all household members sharing land use rights, the Registration Form for Land and Property Changes (Form No. 18) must detail the household members sharing land use rights.
