The Department of Secured Transactions Registration and State Compensation (Ministry of Justice) has issued a document to Land Registration Offices under the Departments of Agriculture and Environment in provinces and cities, providing guidance on the implementation of new regulations regarding the registration of secured transactions using land use rights and assets attached to land.

Previously, the National Assembly adopted Resolution No. 254/2025, which outlines specific mechanisms and policies to address challenges in the implementation of the Land Law. This resolution took effect on January 1, 2026.

Accordingly, when registering mortgages of land use rights and attached assets under Point b, Clause 1, Article 133 of the Land Law, registration authorities only need to update the changes in the Land Database, without requiring direct confirmation of the mortgage content on the issued Certificate (red book).

Based on this, the Department of Secured Transactions Registration and State Compensation has instructed local land registration agencies to uniformly apply the principle of not recording mortgage details on Certificates for new registration applications.

Instead, all mortgage information will be centrally updated and managed in the electronic Land Database System. This approach minimizes physical alterations to red books and pink books, enhancing transparency and facilitating easier verification.

Updating and removing land mortgage records through the database will accelerate the digitalization process in the natural resources and environment sector.

In cases where assets are partially released from the mortgage or the mortgage is removed, and the details were previously recorded on the Certificate, the registration authority will still confirm the removal or changes directly on the book, while simultaneously updating the Land Database.

Until a new decree replaces the existing one, the Ministry of Justice advises local authorities to continue using the registration request forms and templates as per Decree No. 99/2022/NĐ-CP.

In practice, the procedures and documentation for mortgage and mortgage removal remain largely unchanged. However, the shift to digital data updates is expected to significantly reduce processing times. Professional brokers in the Cát Lái Ward (Ho Chi Minh City) note that data digitalization enables banks to disburse funds more quickly when residents borrow or renew loans, reducing wait times associated with multiple paper-based confirmations.

According to Dr. Phạm Viết Thuận, Director of the Institute of Natural Resources and Environmental Economics in Ho Chi Minh City, the implementation and operation of an electronic database in land management not only simplifies procedures and reduces the risk of document damage for citizens but also lays a crucial foundation for accelerating the digital transformation of the natural resources and environment sector in the coming years.
