Land Area Increase Due to Re-Measurement: Are Additional Taxes Required When Renewing the Red Book?

A citizen reported that their family’s land had been issued a land use right certificate (red book). However, upon remeasurement, the actual land area increased by 18 square meters compared to the issued red book. The Ward People’s Committee confirmed that the discrepancy was due to measurement errors during the initial red book issuance.

The citizen inquired whether they would need to pay additional taxes when applying for a new red book reflecting the updated land area.

In response, the Ministry of Agriculture and Environment stated that cases involving land area increases compared to previously issued certificates are addressed under Article 24, Clause 2 of Decree No. 101/2024/NĐ-CP issued by the Government.

The process for issuing new certificates in cases of increased land area due to boundary changes follows the procedures outlined in Section VI, Content C, Part V of Appendix 01, attached to Decree No. 151/2025/NĐ-CP dated June 12, 2025, by the Government.

The Ministry of Agriculture and Environment advises citizens to contact their local Land Registration Office for detailed guidance.

Specific Cases Eligible for New Red Book Issuance

Article 24 of Decree No. 101/2024 outlines the procedures for issuing red books to land plots with increased areas compared to previously issued land documents or certificates.

Under Clause 2 of this Article, for land plots already issued a certificate, the following cases apply:

Specifically, if the increased area resulted from the transfer of partial land use rights, but the transfer procedure was not completed before the Decree’s effective date (August 1, 2024), the land user may apply for a certificate covering the entire land area in use.

The Land Registration Office will update the certificate of the transferor accordingly.

If the increased area has valid land use documents as per Article 137 of the Land Law, the land type and area for certification will be determined for the entire original plot and the additional area according to Article 141 of the Land Law.

For increased areas not falling under the above cases, if they meet the certification criteria under Articles 138, 139, and 140 of the Land Law, a certificate will still be issued for the entire land area in use.

Notably, applicants for certification in the above cases are exempt from land use transfer procedures, land use purpose conversion, and land plot consolidation for the increased area.
