The Construction Law 2025 (Law No. 135/2025/QH15) was passed by the National Assembly on December 10, 2025, and will come into effect on July 1, 2026.
Specifically, clauses 2 and 3 of Article 43, Article 71, and clauses 3, 4, and 5 of Article 95 will take effect from January 1, 2026.
According to Article 95 of the Construction Law 2025, construction investment projects and designs approved before the law’s effective date (July 1, 2026) are exempt from re-approval procedures. Subsequent project activities not yet implemented will follow the provisions of the Construction Law 2025.
Notably, Article 95 also outlines cases where construction design adjustments do not require permit amendments.

Consequently, structures permitted under the 2014 Construction Law but now exempt under the new regulations will not require permit adjustments for design changes.
Additionally, projects permitted before January 1, 2026, with feasibility study reports for adjustments approved by competent authorities, are also exempt from permit amendments.
Furthermore, the 2025 Construction Law allows structures exempt from permits under the 2014 law, eligible to commence before January 1, 2026, to remain exempt.
Thus, the 2025 Construction Law identifies two scenarios exempt from construction permit adjustments.
First, structures permitted under the 2014 law but now exempt, even with design changes, do not require permit adjustments.
Second, projects permitted before January 1, 2026, with approved adjusted feasibility studies, are also exempt from permit amendment procedures.
