Bcons Newsky Project Launch: Official Clarification from the Department of Construction

Mr. Do Diep Gia Hop, Deputy Head of the Traffic Infrastructure Maintenance and Operation Department (Ho Chi Minh City Department of Construction), provided updates during the press conference on January 15, 2026.

According to media reports, the Ho Chi Minh City Department of Construction recently updated the list of housing projects in Binh Duong that are not yet eligible for the sale of future housing units. However, on January 11, 2026, at the White Palace event center on Pham Van Dong Street, developer Bcons officially launched the Bcons Newsky project and began accepting “booking” payments, converting them into deposit contracts (while the project was still in the foundation stage).

Addressing this issue, Mr. Do Diep Gia Hop stated that upon review, the Department has not issued any official documents confirming that the aforementioned project meets the requirements for the sale of future housing units.

The Department of Construction acknowledges the media’s report regarding the signing of deposit contracts for apartments at the Bcons Newsky project and has forwarded the information to the specialized inspection department for further investigation and action in accordance with their authority and regulations.

Expanding on the relevant laws, Mr. Hop noted that under the 2023 Real Estate Business Law, project developers are prohibited from authorizing any organization or individual to sign deposit contracts, purchase agreements, transfers, or lease-to-own agreements for housing units, construction works, or land plots with technical infrastructure within real estate projects.

Developers are only permitted to collect a deposit of up to 5% of the sale or lease-to-own price for housing units, construction works, or floor areas within construction works from the depositor when the housing unit or construction work meets all legal requirements for commercialization.

Additionally, deposit agreements must clearly state the sale or lease-to-own price of the housing unit, construction work, or floor area within the construction work.

Mr. Hop further explained that the 2023 Real Estate Business Law mandates that before selling or leasing future housing units, developers must notify the provincial real estate management authority in writing that the housing units are eligible for sale or lease.

Within 15 days of receiving such notification, the provincial real estate management authority is required to verify the housing units’ eligibility for commercialization and respond in writing to the developer. If the units do not meet the requirements, the authority must provide a clear explanation.
