The People’s Court of Area 2 – Hanoi has issued a decision to initiate bankruptcy proceedings against Shipbuilding Industry Corporation (SBIC) and Ben Thuy Shipbuilding One-Member LLC. This decision was made after the court found sufficient evidence that both companies are insolvent.

According to the bankruptcy proceedings decision, the People’s Court of Area 2 – Hanoi requires creditors of the two companies to submit their debt claims to the court (located at 30 Huynh Thuc Khang Street, Lang Ward, Hanoi), the administrator, or the asset management and liquidation company within 30 days from January 14, 2026, except in cases of force majeure or objective obstacles as defined in Article 66, Clause 4 of the Bankruptcy Law.

Debt claims must specify the total debt, including: outstanding debt and accrued interest; debt not yet due; secured debt and its method of security; unsecured debt; and any contractual compensation (if applicable).

Debt claims must be accompanied by supporting documents and evidence. They must be signed by the creditor or their legal representative and bear the company seal (if the creditor is a legal entity).

Previously, on October 8, 2025, the People’s Court of Area 2 – Hanoi accepted the bankruptcy petitions filed by Shipbuilding Industry Corporation (headquartered at 172 Ngoc Khanh, Giảng Võ Ward, Hanoi) and Ben Thuy Shipbuilding One-Member LLC (headquartered at Block 7, Nghi Xuan Commune, Ha Tinh Province).

After reviewing the documents and evidence related to the bankruptcy petitions, the court found sufficient proof of insolvency for both companies. As a result, the People’s Court of Area 2 decided to initiate bankruptcy proceedings and assigned Judge Hoang Nghia Hai to oversee the process.

The bankruptcy decision has been sent to the two companies, their creditors and debtors, the Ministry of Construction, the Ministry of Finance, the People’s Procuracy of Area 2 – Hanoi, the Civil Judgment Enforcement Department of Area 2 – Hanoi, and relevant agencies such as Social Insurance, Tax Department, and the National Business Registration Portal.

Shipbuilding Industry Corporation (business registration number 0100113303, first registered on July 5, 2006, with the 12th change registered on November 5, 2024) is legally represented by Mr. Pham Hoai Chung (Chairman of the Members’ Council).

Ben Thuy Shipbuilding One-Member LLC (business registration number 3000105505, first registered on August 31, 2011, with the 6th change registered on November 16, 2020) is legally represented by Mr. Vo Duc Tai (General Director).

Under the new jurisdiction outlined in Resolution No. 81/2025/UBTVQH15 dated June 27, 2025, by the Standing Committee of the National Assembly, the People’s Court of Area 2 – Hanoi is responsible for handling bankruptcy cases in 18 northern provinces and cities, as well as civil, business, commercial, and intellectual property disputes involving technology transfer for 20 provinces and cities nationwide.
