Pension and Allowance Termination Cases
Termination of monthly pension and social insurance allowance occurs in the following situations:
– Death or declared deceased by a court.
– Written refusal to receive the pension or allowance.
– Determination by a competent authority that the social insurance benefits were unlawfully granted.
Resumption of Pension After Suspension
According to Articles 75.1 and 75.2 of the 2024 Social Insurance Law, beneficiaries whose pensions were suspended under Section 1 may resume payments in the following cases:
For monthly pensions of individuals under Section 1.1 who have died or been declared deceased by a court:
Payments resume under these conditions:
– Return of individuals who emigrated illegally.
– Court decision to revoke the declaration of missing or deceased status.
– Verified information for beneficiaries under Section 1(iii).
Note: Resumed pensions include both the monthly pension and any unpaid social insurance allowances.
For cases of written refusal to receive pensions:
Payments resume from the date the social insurance agency receives the request to reinstate the pension or allowance, excluding unpaid amounts during the refusal period.
Additionally, beneficiaries whose pensions were suspended or who were declared deceased by a court may receive unpaid pension and allowance amounts if they meet one of the following conditions:
– Return of individuals who emigrated illegally.
– Court decision to revoke the declaration of missing or deceased status.
– Resumption of suspended pensions due to unverified beneficiary information upon successful verification with the social insurance agency or its authorized service provider.
