According to the Vietnam Social Security, Decree No. 374/2025/NĐ-CP outlines that the application for unemployment benefits consists of three essential components.
First, the application for unemployment benefits, as per Form No. 10 issued with the Decree. This document expresses the employee’s intention to receive unemployment benefits upon meeting the legal requirements.
Second, documents confirming the termination of the labor contract, work contract, or employment. These may include: expired or completed labor/work contracts; termination, dismissal, or disciplinary discharge decisions; notices or agreements to terminate labor/work contracts; or employer-issued confirmations detailing the employee’s information, contract type, termination reason, and date.
For employees on fixed-term contracts of 1 month to under 12 months, the termination confirmation must be the original or certified copy of the signed labor contract. In exceptional cases where the employer lacks a legal representative or authorized person, employees may request the Department of Home Affairs to confirm the termination following the procedures outlined in the Decree.
Third, the social insurance booklet. The social insurance agency is responsible for verifying unemployment insurance contributions and returning the booklet to the employee within the stipulated timeframe, serving as the basis for processing unemployment benefits.
Regarding submission methods, within 3 months of contract termination, unemployed individuals seeking benefits must submit one application set directly to the public employment service organization in their desired benefit location or via the National Public Service Portal.
In cases of illness, maternity, accidents, natural disasters, epidemics, or other force majeure events, applications may be submitted through an authorized representative or postal services as regulated.
Decree No. 374/2025/NĐ-CP also clarifies the responsibilities of public employment service organizations in receiving, verifying applications, scheduling result delivery, and submitting cases to competent authorities for benefit approval. Incomplete or unclear applications will require additional documentation from the applicant. Unqualified applicants will receive written rejections with specific reasons.
Notable Adjustments to Unemployment Benefits Effective January 1, 2026
As of January 1, 2026, the Employment Law 2025 will come into effect, introducing significant adjustments to the eligibility criteria, benefit amounts, duration of benefits, and termination of unemployment allowances.
