Businesses facing criticism for holding onto land without development plans

Four companies, namely Xuyen A Joint Stock Company, Delta Joint Stock Company, An Thanh Trading and Services Joint Stock Company, and Thuan Thanh Brick Limited Liability Company, have been publicly disclosed as land violation offenders, lagging in land development in the province of Hai Duong.

4 companies publicly violated land laws

    

Pursuant to the Land Law 2013 and the guidance of the Ministry of Natural Resources and Environment, the provincial People’s Committee of Hai Duong province has directed the periodic inspection and public disclosure of information related to land violations based on the proposal of the Department of Planning and Investment of Hai Duong province regarding projects that are behind schedule. In 2023, the Department of Natural Resources and Environment of Hai Duong province inspected and reviewed the compliance with land laws of 18 companies with a total land area of over 45 hectares.

The Department of Natural Resources and Environment of Hai Duong province has prepared a report and agreed with the provincial People’s Committee of Hai Duong province to publicly disclose violations by 4 companies, namely Xuyen A Joint Stock Company, Delta Joint Stock Company, An Thanh Trading and Services Joint Stock Company, and Thuan Thanh Brick Company Limited.

    

In particular, Xuyen A Joint Stock Company is the investor of a project for accommodation, event organization, and dining services in Phu Binh Ward, Nhi Chau Ward, Hai Duong City. The level of violation is that the investor has not implemented the project, which has been delayed for about 76 months. The current status of the project is that the land has been filled, and construction of the wall, gate, guardhouse, 1 operating house has been completed, leaving an empty area of about 20,000m2.

    

Delta Joint Stock Company is the investor of a hospital construction project in Viet Hoa Ward, Hai Duong City. The level of violation is that the investor has not implemented the project, which has been delayed for about 43 months. The current status of the land is vacant, with an area of about 20,000m2 out of 49,296m2.

    

An Thanh Trading and Services Joint Stock Company is the investor of a project for agricultural product production and workshop rental in the north of National Highway 5, Cam Phuc Commune, Cam Giang District.

    

The level of violation is that the investor has not implemented the project, which has been delayed for about 36 months. The current status is that there is a 2-floor office building (which has been downgraded) that has been abandoned for many years, and the remaining land area is vacant.

    

Thuan Thanh Brick Company Limited is the investor of a project for guesthouse and service business construction in Nhi Chau Ward, Hai Duong City. The level of violation is that the investor has not implemented the project, which has been delayed for about 59 months. The current status of the project area is only used as a warehouse.

    

      

    

    

“Holding onto land” for 15 years without implementation, Vinamit Joint Stock Company is proposed to have its land recovered

    

The Department of Natural Resources and Environment of Hai Duong province recently proposed that the provincial People’s Committee not extend the land use term for Vinamit Joint Stock Company and at the same time recover more than 34.7 hectares of the company’s project land.

    

Accordingly, in 2008, Vinamit Joint Stock Company was granted a lease of over 34.7 hectares of land in Ai Quoc and Nam Dong Wards (Hai Duong City) by the provincial People’s Committee to implement a project for a processing factory, a general warehouse for preserving fruits and vegetables, and a showcase of agricultural product production processes. However, the company has not implemented the project for many years and has been granted extensions by the province several times.

    

As of now, the company has been behind schedule in land use for more than 30 months since the last adjustment of the project implementation schedule.

    

According to the Department of Natural Resources and Environment, in the past years, the company has sent several letters to the Provincial Party Committee, the provincial People’s Committee, and relevant agencies requesting support, establishment and approval of detailed construction plans at a 1/500 scale, and implementation of the project to build a commercial and service area and a new residential area in Ai Quoc Ward (Hai Duong City).
