On the morning of March 7, Chairman of the National Assembly’s Legal Committee Hoang Thanh Tung presented a report at the second national conference on the implementation of laws and resolutions of the 6th session and the 5th extraordinary session of the 15th National Assembly.
Regarding the supervision of the implementation of the Housing Law, Mr. Tung emphasized that the Housing Law was passed by the National Assembly at the 6th session and will take effect from January 1, 2025. It introduces many new and important contents on administrative procedure reforms in the field of housing, creating convenience for people and businesses, reducing compliance costs; adding many specific preferential mechanisms, streamlining procedures for investment in housing development projects to mobilize social resources and encourage businesses to participate in housing development, with a focus on renovation projects, reconstruction of apartment buildings, construction of social housing for workers and low-income individuals; adding and improving many regulations to address causes of disputes and complaints related to housing, enhancing the quality and efficiency of management and use of apartment buildings.
Mr. Tung stated that the Legal Committee has developed a supervision plan for 2024, focusing on monitoring the progress of construction, issuing detailed regulations for the implementation of the Housing Law, including: Timeliness and completeness of issuing normative legal documents as stipulated in Clause 2, Article 11 of the Law on Promulgation of Normative Legal Documents and Clause 1, Article 40 of the Law on Supervisory Activities of the National Assembly and People’s Councils; constitutionality and legality, consistency within the legal system, and compliance with the authority, form, procedure for promulgating legal documents; propaganda, dissemination, and legal education on housing.
In addition, the Standing Committee of the National Assembly’s Legal Committee is currently assisting the specialized supervision delegation of the National Assembly in “The implementation of policies and laws on real estate market management and social housing development from 2015 to 2023” under the National Assembly’s supervision program for 2024 and the assignment of the National Assembly’s Standing Committee. The focus is on the content related to social housing development.
The Legal Committee of the National Assembly proposed that the Government proactively implement effective solutions to regulate housing prices, concentrating on the development of affordable social housing suitable for middle and low-income individuals; accelerate the approval of housing development projects to increase supply, and intervene when the market shows signs of “overheating” or “speculation”; pay attention to the construction of real estate databases and information, enhance the capacity to manage and regulate the land and real estate market, aiming for transparency, openness, and professionalism.
To continue the implementation of the Housing Law to meet the set requirements, the Standing Committee of the Legal Committee recommended that the Government promptly issue detailed regulations for the implementation of the Housing Law to ensure progress, quality, and synchronization with other related laws recently passed by the National Assembly, such as the Land Law, the Real Estate Business Law, and the Credit Institutions Law. During the implementation process of the Law, the Government should guide and direct the handling of issues and obstacles in accordance with the practical requirements and the provisions of the law and resolutions of the National Assembly.
At the same time, the Government should conduct research and submit for approval a pilot program to allow the implementation of commercial housing projects through agreements on land use rights or other land rights (excluding residential land). The pilot program should be implemented in some major provinces and cities to promptly resolve difficulties and obstacles for real estate projects, release land resources, promote socio-economic development, and fully contribute to the goals of the project “Investment in the construction of at least 1 million social housing units in the period of 2021-2030”.
Chairman of the National Assembly’s Legal Committee Hoang Thanh Tung suggested that the Government actively implement new policies and regulations on social housing to attract resources for the development of this segment, contribute to addressing the shortage of affordable housing, and help achieve the objectives of the project “Investment in the construction of at least 1 million social housing units in the period of 2021-2030”.
