Business withdraws offer to give away house on “golden land” to Da Lat

Dalat B&T Co., Ltd. has decided to retract its intention to donate the property at 01 Tran Quy Cap, Ward 10, Dalat City, Lam Dong Province, after the land in this "golden area" was reclaimed.

According to the information from the People’s Committee of Lam Dong province, the provincial leaders have assigned the Department of Finance to preside over and coordinate with relevant units to consider the proposal of Dalat B&T Company when they want to withdraw their proposal to donate the assets on land at 01 Tran Quy Cap Street.

The current condition of the 3-story house that Dalat B&T Company no longer wants to donate to Lam Dong province.

The related assets that Dalat B&T Company no longer wants to donate are a 3-story house with a total floor area of nearly 1,172 m2 at 01 Tran Quy Cap Street after this “golden land” area was reclaimed by the People’s Committee of Lam Dong province. The entire house and land are currently being planned by the province for auction leasing.

Previously, on September 25, 2023, Dalat B&T Company sent a document to the People’s Committee of Lam Dong province, expressing its desire to donate (voluntarily transfer ownership) all the assets on the land that the company has invested in. This donation by the company is in accordance with Decree 29/2018/ND-CP and is not subject to any conditions imposed on the People’s Committee of the province.

In November 2023, the company requested the provincial People’s Committee to supplement the conditions for auctioning assets on the land at the premises of the 01 Tran Quy Cap Street.

In which, the company wants to supplement the condition “in addition to paying the full amount of the auction, the winning bidder is responsible for refunding the value of the assets on the land” (the house donated by the company – PV) that they have invested with an amount of 9.9 billion VND. This is the amount that the company spent to transfer the house and then donate it to Lam Dong province.

The reason the company wants to donate is to use the property for social purposes, for the community’s benefit. However, this house and land will be auctioned for production – business purposes, so the company requests a refund of the above-mentioned amount.

By December 6, 2023, this proposal was rejected by the Department of Finance of Lam Dong province because the house has been accepted and the procedures for transferring ownership to the province have been completed by Da Lat City People’s Committee. Therefore, this is a property owned by the state, and all related issues related to management and use must be implemented in accordance with the laws on state property management.

In addition, in the donation document, the enterprise committed “not to impose any conditions or constraints on the People’s Committee of the province and relevant authorities. The company does not require any refund or payment related to the voluntary transfer and donation of the assets.”

However, the director of Dalat B&T Company believes that as of December 6, 2023, the People’s Committee of Lam Dong province had not issued a decision to establish the people’s ownership rights for the house; the determination of the Department of Finance that the house is “state-owned property” is unfounded.

Dalat B&T Company also withdraws the proposal to donate the assets on the land and requests the functional authorities of Lam Dong province not to establish state ownership rights for this house.
