Lam Dong: Nearly 1.5 hectares of forest land illegally converted for non-forestry purposes in Nam Ho tourist area

The Lam Dong Provincial People’s Committee has issued a decision to administratively sanction Nam Ho Construction and Tourism Joint Stock Company for violations related to the Nam Ho Resort and Tourism Area project (Sub-zone 151, Ward 11, Da Lat City).

Accordingly, Nam Ho Construction and Tourism Joint Stock Company has transferred 1.43 hectares of protective forest land to another purpose (non-agricultural land) without permission from the competent authority to construct facilities for this project.

According to regulations, the fine for this violation is VND 150 million, but the fine for an organization is twice that of an individual, so Nam Ho Construction and Tourism Joint Stock Company was fined VND 300 million.

In addition, the Lam Dong provincial functional agency also ordered the investor to return more than VND 3.9 billion of illegal profit obtained from the above violation.

A few days earlier, the Da Lat City People’s Committee had issued a document requesting Nam Ho Construction and Tourism Joint Stock Company to voluntarily and thoroughly dismantle 48 semi-permanent auxiliary works that had arisen during use. The deadline for completion is May 10.

Da Lat City also requested that the company strictly comply with the suspension of construction of violating works, comply with the decisions on sanctions and remedies according to regulations; use the works for the right purpose in accordance with the construction permit and investment registration certificate that have been granted.

The city leaders also assigned Ward 11 People’s Committee to organize the inspection and screening of violating items and to handle 37 works that violated construction order. Investigation shows that these were illegally constructed works but have not yet been recorded by functional agencies for handling.

In addition, Ward 11 People’s Committee must urgently complete the dossier, submit it to Da Lat City People’s Committee to issue a decision to enforce the violating work in accordance with the 3 administrative sanction decisions issued earlier.

Da Lat City People’s Committee assigned the Department of Urban Management, the City’s Urban Order Management Team to continue inspecting, monitoring and督促ing the implementation of Ward 11 People’s Committee.

“After the above deadline, in case Ward 11 People’s Committee fails to complete the dossier submitted to the City People’s Committee or prepares an improper dossier, it shall consult and propose that the Da Lat City People’s Committee handle the responsibility of the leaders and officers assigned tasks” – emphasized the instruction of the leaders of Da Lat City.

The Nam Ho Tourism Area Project was approved by the Lam Dong Provincial People’s Committee in March 2005 with an area of 10.3 hectares, then increased to 15 hectares, with a total investment of VND 110 billion.

According to the Lam Dong Provincial Inspectorate, from 2010 to 2021, the project, with 5 extensions of progress and 2 adjustments to the overall planning, demonstrated the weakness in investment as well as the financial capacity of the investor.
