The Ministry of Information and Communications is seeking feedback on a draft circular that outlines the sectors under its management and the period during which individuals with relevant positions and authority are restricted from establishing or holding managerial or executive positions in private enterprises, limited liability companies, joint-stock companies, partnerships, and cooperatives after leaving their posts.
This circular applies to individuals who previously held positions with authority in state agencies, organizations, and units within the scope of management of the Ministry of Information and Communications, as well as other relevant agencies, organizations, and individuals.
According to the draft, there are 14 sectors under the management of the Ministry of Information and Communications where individuals with relevant positions and authority are restricted from establishing or holding managerial or executive positions in enterprises or cooperatives after leaving their posts.
These sectors include publishing, printing, and distribution; broadcasting; electronic information; external information; grassroots information; postal services; telecommunications; radio frequency; information technology industry; information technology application and digital transformation; network information security; electronic transactions; and state-owned enterprise management where the Ministry of Information and Communications acts as the representative owner.
This also includes programs, schemes, and projects within the aforementioned fields.
The draft also specifies the duration of the restriction on establishing or managing enterprises in the previously managed sectors.
For individuals who did not hold leadership or management positions, the proposed restriction period is 12 months from the date of leaving the post as decided by the competent authority.
For individuals who held leadership or management positions, the restriction period is 24 months from the date of leaving the post as decided by the competent authority.
For the field specified in item 14 (programs, schemes, and projects within the aforementioned fields), the restriction period is until the completion of the respective program, project, or scheme.
