Review and address difficulties for proactive implementation of the 2024 Land Law

The Hanoi City Party Committee has directed agencies, departments, districts, and counties to review and prepare the necessary conditions for better coordination in implementing the Law. This includes the work of issuing land use right certificates and ownership certificates for assets attached to the land (red book).

Simultaneously, the Hanoi Party Committee directs the departments and sectors to continue reviewing, classifying, studying, and guiding the resolution of difficulties and obstacles for cases that do not meet the conditions for certificate issuance. They also oversee the implementation of the 2023 Housing Law, the 2024 Land Law, and their guiding documents, ensuring administrative reform and compliance with legal regulations.

The project to build a general plan for land dossiers and a land management database, approved by the People’s Committee, will continue to be completed. This will serve as the basis for declaration and certificate issuance for the remaining cases.

People’s Committees of districts, counties, and towns shall promptly deploy the project to build a comprehensive system of land dossiers and a land management database. They will coordinate closely with the Department of Natural Resources and Environment, the project’s construction and inspection units, and the branches of the Land Registration Office to update any errors or arising issues. This collaborative effort will ensure timely resolution without hindering the administrative procedures of the Land Registration Office system.

The Hanoi City Party Committee has directed a review of necessary conditions for better coordination in implementing the Land Law.

Commune-level People’s Committees will collaborate with consulting units to review the results of the commune’s land map measurement to notify land users and ensure that 100% of the land plots in the area are fully declared and registered.

Furthermore, the Hanoi Party Committee demands strict handling of any negative issues related to certificate issuance. It also emphasizes the need to study and contribute to the draft decisions of the People’s Committee, which will regulate land-related matters within their jurisdiction according to legal provisions.

Thanks to the resolute and close direction of the Hanoi Party Committee regarding land-related matters, there have been positive changes in the work of issuing certificates for the first time and resolving dossiers related to land-use right registration for households and individuals in the city.

Currently, the rates of first-time certificate issuance and land declaration and registration for households and individuals have reached 99.6%. The rates of certificate issuance for home buyers in real estate development projects and resettlement areas stand at 86.28% and 94.11%, respectively. The figures for religious establishments and faith institutions are 72.1% and 62.17%, respectively.

New Law supports stable market development

In a conversation with Tien Phong about preparing for the implementation of the Land Law, Mr. Nguyen Van Dinh, Chairman of the Vietnam Real Estate Brokers Association, shared his view that the Law provides guidelines and policies to address land-related matters. However, he noted that the understanding of the legal nature of land varies among localities.

Therefore, it is essential to have guiding documents, such as circulars and decrees, to assist responsible units in implementing the Law. These documents should provide detailed instructions on specific issues, chapters, and sections. The National Assembly is actively promoting this aspect.

Ministries involved in the new laws, including the Land Law, Housing Law, and Real Estate Business Law, are expediting the drafting of guiding circulars and decrees. They are also seeking input from various sectors and benefiting from the contributions of experts, scientists, and enterprises to finalize the content.

People and businesses eagerly await the new laws, which will contribute to a healthier and more stable market.

The aim is to make these guiding documents a practical handbook for local authorities to resolve stalled projects in their areas. The new Law itself has already untangled contradictions and overlaps from the previous legislation.

By addressing these bottlenecks, localities will be able to boost economic development and achieve planning and strategic goals. Moreover, detailed guiding circulars and decrees will provide local authorities with reassurance and reduce the fear of making mistakes during project handling.

Mr. Dinh also highlighted that the new laws enable enterprises to handle project procedures correctly and appropriately, preventing errors that could lead to misunderstandings and approval challenges. As a result, businesses will be more inclined to comply with the law in a more accurate, comprehensive, and timely manner.
