According to information from the public security agency, from 2020 until her arrest, the accused, Bui Thi Kim Dung (born 1972, residing in So Dau ward, Hong Bang district, Hai Phong city), used her position as Director and legal representative of Commercial Service Trading Company Rainbow Orchid 7&1 (address: 457 Hoang Minh Thao, Du Hang Kenh ward, Le Chan district, Hai Phong city) to transfer land plots from two commercial housing projects to multiple individuals.
However, according to regulations, the investor of the two commercial housing construction projects in Ai Ba Chuc and Quai Chao areas is not permitted to sell land plots and has not been authorized by competent authorities to sell future formed houses.
During this process, Bui Thi Kim Dung received over VND 293 billion by transferring 204 land plots from the above-mentioned projects to 46 people. These individuals have not received the land or refunds from Dung. After receiving the money, Dung did not deposit it into the account of Commercial Service Trading Company Rainbow Orchid 7&1 to continue implementing the projects but used it for personal purposes.
While the public security agency was investigating the case, Commercial Service Trading Company Rainbow Orchid 7&1 organized information sessions and trained their real estate transaction floor staff to advertise and sell the land plots from the above-mentioned commercial housing projects.
Based on the collected documents and evidence, on May 16, 2024, the Security Investigation Agency (Hai Phong City Public Security) decided to prosecute Bui Thi Kim Dung for “Forging seals, documents of agencies and organizations; Using forged seals or documents of agencies and organizations”. On August 1, 2024, the investigation was expanded, and the Security Investigation Agency (Hai Phong City Public Security) decided to additionally prosecute Bui Thi Kim Dung for “Appropriating property by fraud”
To facilitate the investigation, ensure compensation, and protect the rights of involved parties, on August 21, 2024, the Security Investigation Agency (Hai Phong City Public Security) proceeded to distrain 204 out of 224 land plots belonging to the above-mentioned commercial housing construction projects. These land plots had been granted Land Use Right Certificates and Ownership of Houses and Other Assets Attached to Land by the Department of Natural Resources and Environment of Hai Phong City to Commercial Service Trading Company Rainbow Orchid 7&1.
The Security Investigation Agency of Hai Phong City Public Security announces that individuals and organizations who have transferred money to Bui Thi Kim Dung and Commercial Service Trading Company Rainbow Orchid 7&1 for the transfer of land in the above-mentioned projects but have not yet contacted, provided information, documents, or related contracts to the Security Investigation Agency of Hai Phong City Public Security are requested to promptly do so.
