Update on Land Title Certificates in Ho Chi Minh City: Addressing Resident Concerns

Voters have raised concerns about the long-awaited land title certificates for their homes in the An Suong residential area project (District 12). In response, the Ho Chi Minh City People’s Committee has committed to resolving this issue, instructing relevant departments to collaborate with the project investor to find a solution for the affected residents.

Ho Chi Minh City plans to resolve issues for over 81,000 apartments/houses in hundreds of projects, but the results so far have been modest.

The Department of Natural Resources and Environment has shared that they have issued land title certificates for most of the land plots in the An Suong residential area project to the Ho Chi Minh City Housing Development and Trading Company Limited.

The remaining plot is awaiting compensation and clearance by the project investor. The department has provided guidance to the investor to complete these tasks.

Additionally, the Ho Chi Minh City Police Department has requested information and documents related to the An Suong project from the Department of Natural Resources and Environment to aid in their investigation. As a result, administrative procedures will be temporarily suspended until further notice from the investigating authority or a competent agency.

Meanwhile, residents of the social housing complex at 35 Ho Hoc Lam (Binh Tan District) have also requested land title certificates. According to the Department of Natural Resources and Environment, under Decree 43/2014, which provides guidance on implementing the 2013 Land Law, their department provided opinions on “conditions for the transfer of land use rights and the sale of houses and construction works by the project investor.” The Ho Chi Minh City Land Registration Office was then responsible for considering and issuing land title certificates to homebuyers in the project.

However, with the enactment of Decree 101/2024 on basic land surveys, registration, and land title certificate issuance (effective from August 1), the Department of Construction is now responsible for providing opinions on “confirmation that houses, construction works, and construction items meet the conditions for use as prescribed by law” and “confirmation that land use rights and assets attached to land meet the conditions for business as prescribed by law on real estate business.” The Ho Chi Minh City Land Registration Office is now responsible for considering and issuing land title certificates. As such, the responsibility for providing opinions on these conditions has been transferred to the Department of Construction.

Regarding the issuance of land title certificates for Block A – Ehome 3 Apartment Building (Binh Tan District), the Department of Natural Resources and Environment shared that Vice Chairman of the Ho Chi Minh City People’s Committee, Bui Xuan Cuong, has directed the Department of Construction to handle this matter, as it pertains to the government’s decision not to purchase 200 apartments.
