In response to the above issue, the Ministry of Construction stated that Article 76 of the 2023 Housing Law specifically defines the subjects eligible for social housing support policies.

According to the Ministry, buyers of social housing must not only belong to the group eligible for housing support policies but also meet the conditions regarding housing and income, as stipulated in Articles 29 and 30 of Government Decree No. 100/2024, which provides detailed guidance on the Law on Housing regarding the development and management of social housing.

Articles 30.1 and 30.2 of Decree No. 100/2024/ND-CP stipulate that for low-income earners in urban areas, workers, and employees of enterprises, cooperatives, and cooperative alliances inside and outside industrial parks, as well as officials, public employees, and civil servants, income conditions must be met.

Specifically, for single individuals, the monthly income must not exceed VND 15 million, based on the salary and wage scale confirmed by the agency, unit, or enterprise where the individual is working.

In the case of married couples, the combined monthly income of both spouses must not exceed VND 30 million, also calculated according to the salary scale confirmed by their workplace.

The time frame for determining the income condition is within one year, counting from the date the buyer submits a valid dossier to the investor to register for the purchase or rent-purchase of social housing.

The Law also stipulates that for low-income earners in urban areas without an employment contract, the monthly income of a single individual must not exceed VND 15 million. If married, the total monthly income of the applicant and their spouse must not exceed VND 30 million.

Within seven days from receiving the request for confirmation, the People’s Committee at the communal level is responsible for confirming the income conditions of the applicant, calculated according to the above-mentioned one-year principle.

Additionally, the housing law also gives priority to women, including single mothers raising children.

According to Point d, Clause 1, Article 79 of the 2023 Housing Law, in cases where individuals have the same standards and conditions, priority will be given in the following order: individuals with revolutionary merits, family members of martyrs, disabled people, resettlers in the form of purchasing or rent-purchasing social housing, and women.

Clause 2, Article 38 of Decree No. 100/2024 of the Government, which provides detailed guidance on the Law on Housing regarding the development and management of social housing, stipulates that the list of priority groups is arranged according to the time of dossier submission. Apartments for priority groups are allocated according to the list until fully distributed, after which the remaining applicants will participate in a lottery.

Regarding the proposal on income conditions for single mothers raising children when buying social housing, the Ministry of Construction has taken note of the citizens’ opinions for synthesis, further study, and improvement of related regulations in the near future.
