
The Chi Hung family (Lam Dong) purchased agricultural land in July 2022. As the land has not been granted a certificate, the two parties drew up a handwritten contract with the confirmation of the village chief. Mr. Hung’s family is still cultivating this land.
The land was granted a land map extract in 2022 by the Land Registration Office and the People’s Committee of the commune, classified as land for long-term tree planting. The previous owner was also granted a certificate of land origin confirmation in 2001 for reclaimed land in 2022, along with a certificate confirming no disputes or planning issues in the same year.
Mr. Hung asks if his family can register for a Land Use Rights Certificate.
In response to this question, the Ministry of Agriculture and Environment stated:
The law on land stipulates the granting of Land Use Rights Certificates and ownership of assets attached to the land in cases where the land use rights have been transferred but the transfer procedures have not been completed as regulated in Section XI, Part C, Chapter V of Appendix I issued together with Government Decree No. 151/2025/ND-CP dated June 12, 2025 – which defines the division of tasks and powers for two levels of local government, including those related to land.
Accordingly, for land use due to the receipt of land use rights that does not comply with the law but has the signatures of the related parties and has not been granted a certificate before August 1, 2024, there must be papers on land use rights as prescribed in Article 137 of the Land Law.
The Ministry of Agriculture and Environment provides this information for the family of Mr. Chi Hung to consider and implement according to the law.
