Cracking Down on False Advertising: A Government Initiative

The Ministry of Culture, Sports, and Tourism is directed to research and implement stricter regulations regarding advertising agencies, practitioners, and influential individuals or celebrities who misuse their credibility to advertise falsely, especially on social media platforms.

This directive comes from the Prime Minister’s Dispatch No. 65, which aims to intensify the fight against smuggling, commercial fraud, counterfeit goods, and intellectual property rights infringements.

Mr. Tran Quang Minh (editor Quang Minh) was recently fined VND 37.5 million for violations in advertising activities.

The Prime Minister has ordered a high-intensity campaign from May 15, 2025, to June 15, 2025, with the formation of a task force led by Deputy Prime Minister Bui Thanh Son, head of the National Steering Committee 389.

The Ministry of Public Security has been tasked with identifying and taking action against individuals and organizations suspected of involvement in smuggling, commercial fraud, and the production and trade of counterfeit goods. They will focus on criminal proceedings to deter and set an example.

The government emphasizes the need to clarify the roles and responsibilities of organizations and individuals in management, licensing, testing, and import-export control of raw materials and goods. Any acts of corruption or negligence will be strictly dealt with, sending a strong message to potential violators and ensuring fair practices across industries.

The Prime Minister has instructed the Ministry of Public Security to analyze and identify the root causes of these crimes and loopholes in the legal framework or management mechanisms that criminals exploit. This will inform future policy improvements to combat such illegal activities effectively.

Regarding the Ministry of Industry and Trade, the Prime Minister has ordered enhanced market management and strict action against the trade of smuggled and counterfeit goods, intellectual property rights infringements, and unclear product origins, with a particular focus on e-commerce platforms.

The Ministry of Health is tasked with intensifying inspections and taking stern action against the trade of counterfeit and smuggled medicines and pharmaceuticals. Additionally, scientists and managers in the healthcare sector are required to refrain from advertising or promoting misleading or exaggerated information about products’ efficacy. They must ensure that any claims are scientifically validated and accurate, holding themselves accountable for any dishonest or deceptive advertising practices.

The Prime Minister has urged local authorities to establish task forces led by provincial/municipal People’s Committee Chairpersons to vigorously direct market management forces to coordinate and handle violations related to smuggling, commercial fraud, counterfeiting, unclear origins, and intellectual property rights infringements within their respective localities.

The Prime Minister has also requested the Provincial/Municipal Party Committees to lead and guide the entire political system in their respective localities to actively engage in the fight against smuggling, commercial fraud, and counterfeiting.
