Two Additional Land Procedures at the Commune Level: What Citizens Need to Know

As of August 25th, the communal authorities will commence the process of facilitating economic organizations to contribute capital in the form of land-use rights for project implementation and allocation of coastal areas for land reclamation.

The Ministry of Agriculture and Environment has issued Decision No. 3380, announcing new and amended administrative procedures in the field of land management under its jurisdiction.

Among the new procedures are two that will now be handled at the communal level: first, the transfer of land use rights to economic organizations through assignment, lease, or contribution of capital in the form of land use rights for investment projects; and second, the allocation of land, leasing of land, and authorization of land reclamation activities.

Previously, these two procedures were carried out by provincial People’s Committees (UBND).

The Ministry has also amended and supplemented 28 administrative procedures, 20 of which are implemented at the provincial level and eight at the communal level.

Specifically, the eight procedures implemented at the communal level include: conversion of land allocation and lease types; land registration and registration of assets attached to land; issuance of land use right certificates (“red books”) for the first time to organizations, individuals, households, community groups, and overseas Vietnamese; approval of multi-purpose land use and extension of multi-purpose land use plans.

In addition, the communal level authorities are responsible for procedures related to land allocation, land leasing, and land use purpose conversion in cases where there is no auction of land use rights or bidding for investors to implement projects involving land use.

They also handle procedures for land allocation and leasing through bidding to select investors for projects involving land use, as well as land allocation with forest allocation, land leasing with forest leasing, and extension of land use rights upon expiration.

The communal level authorities are authorized to adjust decisions on land allocation, land leasing, and land use purpose conversion when there are changes in legal basis, as well as adjust the duration of land use for investment projects.

Furthermore, they are responsible for allocating residential land with payment for land use rights, without auctions or bidding for investors, in special cases as prescribed.

Previously, the Government issued Decree No. 151/2025, which took effect on July 1, defining the division of authority between local administrations at two levels and the delegation of powers and responsibilities in the field of land management.

According to the decree, the Chairman of the communal People’s Committee is authorized to issue land use right certificates (“red books”) to local residents for the first time.

The decree also stipulates that the time limit for initial land and asset registration attached to land shall not exceed 17 working days, and the time limit for issuing the certificate for the first time shall not exceed three working days.
