Ho Chi Minh City THADS Disburses Fourth Payment to Bondholders in Van Thinh Phat Case

At the 4th payment installment, the Ho Chi Minh City Department of Judgment Execution (THADS) has temporarily suspended the collection of judgment enforcement fees.

On September 26, the Civil Judgment Execution Department (CJED) of Ho Chi Minh City announced the fourth payment distribution to bondholders in the Van Thinh Phat case.

According to the announcement, the CJED is executing the judgment in the Van Thinh Phat case based on the First Instance Criminal Judgment dated October 17, 2024, by the Ho Chi Minh City People’s Court, the Appellate Judgment dated April 21, 2025, by the High People’s Court in Ho Chi Minh City, and the Execution Decision as follows:

“Mrs. Truong My Lan is obligated to fully compensate the total amount of VND 30,081 billion to the victims and related parties who acquired the bonds as per the appendices (43,108 individuals), including the following bond codes: QT-2018.12.1; SET.H2025; ADC-2018.09, ADC-2019.01; ADC-2018.09.01, and SNW-2018.10.”

During the execution process, the CJED completed the first payment, totaling over VND 7,464 billion.

On June 25, 2025, and July 15, 2025, payments were made to 41,441 bondholders, amounting to VND 7,250 billion, with each recipient receiving 24.81% of their entitlement.

On July 17, 2025, the second payment of VND 696 billion was distributed to 41,441 eligible bondholders, representing 2.4553% of the executable amount.

On August 15, 2025, the CJED continued payments for the first and second phases to bondholders who updated their account details or provided new information.

On August 20, 2025, the third payment of VND 376 billion was made to 42,141 bondholders, equivalent to 1.25% of the executable amount.

On September 24, 2025, additional payments were made to parties from previous phases who had not provided information, transferred rights and obligations, or had closed or incorrect account details.

Following the first three payments, the CJED recovered over VND 299 billion from asset liquidation.

On September 26, 2025, the fourth payment of VND 299 billion was distributed to 42,313 bondholders, representing 0.9971% of the executable amount.

The CJED has deposited funds for 795 bondholders who have not provided account details, in accordance with regulations.

As of September 26, 2025, the CJED has paid out 29.5152% of the total executable amount.

For the fourth payment, the CJED has temporarily waived execution fees due to numerous requests from bondholders to exempt these charges.

The CJED has reported these requests to higher authorities for consideration of fee waivers for all bondholders and will inform them of the decision once received.

Currently, the CJED is verifying, surveying, and appraising assets belonging to Mrs. Truong My Lan and other obligated parties, as identified in the judgment.

Additionally, the CJED continues to request SCB Bank to transfer frozen funds as per the appellate and first instance judgments.

Once asset liquidation is complete and funds are received from the bank, the CJED will proceed with subsequent payments.
