
The Ministry of Finance has announced the issuance of a Circular regulating the fees for issuing and reissuing Real Estate Brokerage Practice Certificates. This move aims to ensure consistency with real estate business laws, fee regulations, and the state budget.
According to the Ministry of Finance, the Ministry of Construction has provided cost information for issuing certificates, amounting to 307,991 VND per application for individuals.
The proposed fee structure by the Ministry of Construction (300,000 VND for new certificates and 200,000 VND for reissues) aligns with fees for other professional certificates recently implemented. For instance, the fee for issuing a Storage Practice Certificate is 300,000 VND, and reissuing it is 200,000 VND.
As per Article 9 of the Law on Fees and Charges, the fee collection is not intended to cover costs.
Based on the Ministry of Construction’s proposal, the Ministry of Finance plans to set the following fees for issuing and reissuing Real Estate Brokerage Practice Certificates:
Issuing a Real Estate Brokerage Practice Certificate: 300,000 VND per certificate.
Reissuing a Real Estate Brokerage Practice Certificate: 200,000 VND per certificate.
In cases where a certificate is reissued due to errors by state agencies or changes in administrative boundaries as per authorized regulations, no fee will be charged for reissuing the Real Estate Brokerage Practice Certificate under this Circular.
The issuance of this Circular will enhance the legal framework, streamline the certification process for individuals, and ensure transparent and unified fee collection nationwide.
According to the Ministry of Finance, Circular No. 74/2022 currently governs the forms, payment deadlines, and declarations of fees and charges under its jurisdiction. However, with the State Budget Law 2025 taking effect on January 1, 2026, some provisions of this Circular will no longer align with the new law.
To maintain legal consistency and unified application, the Ministry of Finance plans to incorporate the entire content of Circular 74/2022 into a decree replacing Decree 120 and Decree 82, subsequently repealing Circular 74.
