Facilitating Investors and Scientists

On the morning of June 24th, with the majority of delegates in agreement, the National Assembly passed the Law amending and supplementing a number of articles of the Law on Vietnamese Nationality.

Prior to the delegates’ approval, the Minister of Justice, Nguyen Hai Ninh, presented a report on the adoption, explanation, and editing of the draft law. He addressed suggestions for further clarification on the “special mechanism for acquiring nationality.”

In response, the Government clarified that the current Law on Nationality stipulates stringent requirements for those seeking Vietnamese citizenship, including permanent residency and a permanent residence card.

The new law aims to facilitate the process for investors, scientists, and foreign experts by offering more relaxed conditions to attract high-quality resources.

As a result, individuals with outstanding contributions to the cause of building and defending the Vietnamese Fatherland may be exempt from certain requirements when applying for Vietnamese citizenship. These include proficiency in the Vietnamese language for integration, permanent residency in Vietnam, and a minimum of five years of residency…

These cases will be allowed to retain their foreign nationality if they meet two similar conditions: having relatives who are Vietnamese citizens and obtaining permission from the President.

Option for a Combined Name

According to the Minister, some National Assembly deputies suggested that there should not be a rigid requirement for a Vietnamese name, and instead, individuals could use a Vietnamized name or their original name to ensure international integration.

The Government has accepted this suggestion and edited the regulations in Clause 4, Article 19, and Clause 4, Article 23 of the Law on Vietnamese Nationality accordingly. This allows individuals who simultaneously apply for/reacquire Vietnamese nationality and wish to retain their foreign nationality to choose a combined name that includes both their Vietnamese and foreign names.

This provision aims to facilitate their life and work in the countries of their nationality.

According to the new Law on Nationality, those who run for, are elected, approved, appointed, or assigned to hold term-based positions in agencies of the Party, State, Vietnam Fatherland Front, and socio-political organizations at the central and local levels; those who work in cryptology agencies; and those who serve in the armed forces must have solely Vietnamese nationality and permanent residency in Vietnam.

Civil servants and public employees not covered by the above provision must have solely Vietnamese nationality, unless it is beneficial to the Socialist Republic of Vietnam and does not harm the national interests of Vietnam. They must also have permanent residency in Vietnam. The Law authorizes the Government to elaborate on this clause.

The Law amending and supplementing a number of articles of the Law on Vietnamese Nationality will take effect from July 1st, 2025.
