In the afternoon of June 26, at a press conference providing information on economic and social issues in Ho Chi Minh City, Mr. Nguyen Kien Giang, Deputy Head of the Department of Maintenance and Exploitation of Traffic Works Construction under the Ho Chi Minh City Department of Construction, announced that the pilot exemption from construction permits will facilitate and reduce administrative procedures and travel time for residents initiating construction projects in the city upon the completion of the merger of provincial authorities.
According to Mr. Giang, the technical and legal requirements for exemption from construction permits are based on Clause 2, Article 89 of the 2014 Law on Construction. This applies to detached houses with a scale of less than seven floors belonging to investment construction projects in urban areas or housing projects with a detailed plan of 1/500 that has been approved by competent state agencies. The design and construction of detached houses are stipulated in Clause 7, Article 79 of the 2014 Law on Construction, and the implementation is detailed in Clause 3, 4, and 5, Article 9 of the Government’s Decree 06/2021.
In response to Prime Minister’s Official Dispatch No. 78/2025 on focusing on reducing and simplifying administrative procedures in the construction sector, the Department of Construction has coordinated with districts 6, 7, 8, 12, Binh Tan, Tan Phu, Can Gio, Hoc Mon, Nha Be, and Thu Duc City to review housing projects with a detailed plan of 1/500 that has been approved. On July 1, 2025, the Department of Construction will announce the projects with a detailed plan of 1/500 or urban designs approved by competent state agencies that are eligible for exemption from construction permits.
“The areas with the highest concentration of land lots exempted from construction permits are in District 7, Nha Be and Binh Chanh districts, and Thu Duc City,” added Mr. Giang.
In cases of exemption, residents are required to submit a construction commencement notification to the People’s Committee of the commune where the construction takes place, at least seven working days before the commencement of construction. It is important to note that the notification must be accompanied by certified copies of legal land documents and designs that comply with architectural and planning criteria.
To ensure oversight during the construction process, Mr. Giang referred to Clause 3, Article 26 of the 2025 Law on Organization of Local Governments, which empowers the chairman of the People’s Committee at the ward level to inspect compliance with laws related to the construction of detached houses and urban construction works.
Additionally, based on Clause 12, Article 7 of Circular No. 10/2025 issued by the Ministry of Construction, which guides the functions, tasks, and authority of specialized agencies under the People’s Committees of provinces and centrally-run cities in the construction sector, the Department of Economic and Urban Infrastructure is responsible for inspecting the construction of works in accordance with architectural management regulations and approved urban planning designs. They also organize the public announcement of planning schemes.
