Draft Decree on the Construction and Management of Information Systems and Databases for Housing and Real Estate Market

The Ministry of Construction is drafting a Decree on the construction and management of information systems and databases for housing and the real estate market.

According to the Ministry of Construction, on July 24, 2024, the Government issued Decree No. 94/2024/NĐ-CP, detailing certain provisions of the Law on Real Estate Business regarding the construction and management of information systems and databases for housing and the real estate market.

In implementing the provisions of Decree No. 94/2024/NĐ-CP dated July 24, 2024, the Ministry of Construction has developed an information system for housing and the real estate market. It periodically collects and synthesizes information on housing and the real estate market from data shared and reported by ministries, sectors, and localities to serve quarterly reports to the Government and the Prime Minister, as well as for directing and managing operations. However, during the implementation of the Decree, some issues and inconsistencies have arisen that require review and adjustment, such as reporting frequency, data collection content, and data sharing and connection methods between related specialized databases. These issues do not fully meet the new requirements for digital transformation and electronic administrative procedures, particularly the need for “accurate, complete, clean, and live” data as directed by the Politburo in Resolution No. 57-NQ/TƯ dated December 22, 2024. Therefore, revising and replacing Decree No. 94/2024/NĐ-CP dated July 24, 2024, is both appropriate and necessary.

The draft Decree on the construction and management of information systems and databases for housing and the real estate market consists of 6 chapters and 47 articles. In addition to general provisions, the draft specifies regulations on information technology infrastructure and software systems; databases for housing and the real estate market; data sharing and connection; ensuring the quality of the housing and real estate market information system; and data management, exploitation, and publication.

Housing Database

According to the draft, the system includes legal documents on housing issued by the National Assembly, the Government, the Prime Minister, ministries, sectors, and localities within their authority.

Development indicators for housing types are based on approved programs, plans, and projects, including: land area for each housing type; average housing area per capita; total housing floor area; and the number of housing units.

Information and data on housing types developed through housing projects and urban area projects include: commercial housing; social housing; worker dormitories in industrial zones; housing for the armed forces; housing built by the Vietnam General Confederation of Labor; public service housing; resettlement housing; and the renovation and reconstruction of apartment buildings.

Other housing types include: housing for revolution contributors and families of martyrs; housing for poor and near-poor households in poor communes; housing under support policies for flood and storm-resistant housing in the Central region and the Housing Program for the Mekong Delta’s flood-prone areas; public housing assets; rental housing (by individuals, organizations, and businesses); housing (apartments and private homes) sold to foreign organizations and individuals; and housing under other support programs (if any).

Real Estate Database

The system includes legal documents on the real estate market issued by the National Assembly, the Government, the Prime Minister, ministries, sectors, and localities within their authority.

The real estate project database includes information and data on: housing construction investment projects; urban area construction investment projects; rural residential area construction investment projects; construction projects serving education, healthcare, sports, culture, offices, commerce, services, tourism, accommodation, industry, and mixed-use purposes; technical infrastructure construction projects; and industrial zone and high-tech park infrastructure projects.

Generation of Information Codes for Housing and Real Estate Market

Information codes for housing and the real estate market are generated and managed within the information system to track, manage, and connect data as per legal regulations.

Each real estate project is assigned a unique information code, automatically generated by the system, ensuring uniqueness and stability throughout the data lifecycle.

Provincial housing and real estate authorities generate information codes for each real estate project in their jurisdiction upon project approval.

Central and local housing and real estate authorities use these generated codes to link and update data for each real estate product within the project.

The structure of information codes for projects and real estate products (including housing, construction works, mixed-use projects, and other real estate types) is detailed in the Appendices accompanying the Decree.

Data Reception, Processing, Adjustment, and Quality Assurance

According to the draft, the agency managing the housing and real estate market information system is responsible for receiving and processing data before integration and storage, ensuring accuracy, consistency, and compliance.

The agency regularly monitors, corrects errors, and collaborates with relevant bodies to update and adjust data, ensuring quality in management, exploitation, and use as per data laws.

Data quality is ensured through accuracy, validity, integrity, completeness, timeliness, and consistency.

Guidelines for data collection, processing, and synchronization across national, sectoral, and local databases will be provided on the shared system.
