DXG’s $43 Million Saigon Riverside Project Unlocks After 8-Year Stalemate

Ho Chi Minh City’s Task Force 1645, responsible for resolving legal hurdles in issuing land use rights certificates and property ownership for commercial housing projects, has recently reviewed and proposed legal solutions for five projects facing delays. Among these, the Opal Riverside project in Hiep Binh Chanh Ward, Thu Duc City, developed by Dat Xanh Group (DXG), stands out. Despite the project’s completion and occupancy since 2017, residents are still awaiting their property ownership certificates.

According to reports, over 4,900 square meters of land, including waterways and roads managed by the state, remain unresolved within the project’s boundaries. Additionally, the developer has yet to fulfill its supplementary financial obligations for this interspersed public land.

The city has mandated a thorough review of the legal framework and clarification of the developer’s financial responsibilities. Dat Xanh is required to commit to fulfilling all obligations before authorities consider issuing ownership certificates to residents.

Opal Riverside, with a total investment of nearly VND 1 trillion, spans over 20,000 square meters along the Saigon River. The project comprises three 19-story towers, housing 626 apartments and 22 penthouses.

In May 2016, the HCMC People’s Committee approved the transfer of the Hiep Binh Chanh Housing Project from Pacific Infrastructure Development Investment Joint Stock Company to Dat Xanh Group. The project was completed and handed over in late 2017, with a management board established as per regulations. However, the unresolved status of over 4,900 square meters of state-managed interspersed land has significantly delayed the issuance of property ownership certificates.

Since 2019, Dat Xanh has submitted multiple proposals to the Department of Natural Resources and Environment, offering an interim payment of VND 5 billion to facilitate certificate issuance. The group also sought guidance from the Ministry of Natural Resources and Environment on handling interspersed public land within the project. A directive from the General Department of Land Administration dated January 16, 2020, clarified that for projects approved before July 1, 2014, interspersed public land aligned with planning can be reclaimed and allocated to developers without auction.

Currently, HCMC authorities and the developer are working together to resolve outstanding legal issues, aiming to finalize procedures and issue property ownership certificates to residents after years of delay.
