Public Skepticism Over Road Construction for Real Estate Project: What Do Authorities Say?

Amidst concerns that land acquisition for road construction primarily benefits real estate developers, authorities assert that such actions strictly adhere to legal planning regulations.

Recently, Tien Phong Newspaper received a petition from residents of Neighborhood Group 19, Duc Giang Ward, former Long Bien District (now Viet Hung Ward, Hanoi) regarding the project to construct a 13-meter road from the 30-meter road to Duc Giang Street.

Residents reported that the public announcement of the red line boundary (as per the 30-meter to Duc Giang Street planning) was conducted hastily and without proper procedure. Community consultation meetings, such as the one held on February 17, 2023, were deemed superficial and lacked comprehensive information.

The primary concern raised by residents is the true purpose of the road. The planned route passes through areas already allocated to businesses. Specifically, the project’s starting point is the land of Metal Enterprise No. 8, and the endpoint is Metal Warehouse No. 2, both currently used by Hanoi Metal Joint Stock Company. Meanwhile, the land of Metal Warehouse No. 2 has been allocated by the Hanoi People’s Committee to a joint venture between Hanoi Metal Joint Stock Company and Vietnam Infrastructure and Real Estate Joint Stock Company (VIID) for a high-rise residential and commercial complex project.

Residents argue that the road project does not serve national or public interests but rather benefits commercial enterprises, leading to state budget waste. They claim it violates Article 62 of the Land Law, which outlines land recovery cases for socio-economic development in the national and public interest.

According to Viet Hung Ward People’s Committee, since 2023, the former Long Bien District People’s Committee has responded to petitions from households in Groups 9, 10, and 11 of Neighborhood Group 19, Duc Giang Ward, Long Bien District. The response confirms that the project’s approval, information disclosure, and procedures were transparent and compliant.

On July 15, 2022, the former Long Bien District People’s Council approved the investment policy for the project “Construction of a 13-meter road as planned from the 30-meter planned road to Duc Giang Street, Duc Giang Ward, Long Bien District” under Resolution No. 65/NQ-HĐND. Key details include: constructing a 562-meter synchronized road as planned, starting at the intersection with the 30-meter planned road (near Thuong Thanh Ward Health Station) and ending at Duc Giang Street. The project is scheduled for 2023–2025.

To fulfill this task, the former Long Bien District Investment Construction Project Management Board contracted the Hanoi Construction Planning Institute to establish the red line boundary (RLB) at a 1:500 scale and provide technical infrastructure alignment. By November 2022, the institute completed the RLB plan based on the N10 Urban Area Detailed Planning (1:2000 scale), approved by the Hanoi People’s Committee in Decision 6115/QĐ-UBND on November 21, 2014.

Regarding community consultation, Viet Hung Ward People’s Committee stated that from November 25, 2022, after the Hanoi Construction Planning Institute finalized the RLB plan, the former Long Bien District Investment Construction Project Management Board initiated community consultation and publicly displayed the drawings.

On January 12, 2023, the Long Bien Project Board invited residents to a public consultation meeting. Twelve households from Neighborhood Group 20 attended, while representatives from Neighborhood Group 19 were absent.

Regarding residents’ rights within the planned area, Viet Hung Ward People’s Committee representatives affirmed: The 2024 Land Law and Decree 151/NĐ-CP stipulate that transactions such as buying, selling, or inheriting land within urban and rural planning areas, approved and announced by competent state agencies but not yet implemented, without land recovery decisions, and not included in the annual land use plan of the commune-level authority, allow land users to conduct transactions as per the Law. Additionally, residents may apply for temporary construction or renovation permits for housing as per relevant regulations.
