Decree 282/2025 (replacing Decree 144/2021) introduces several changes to administrative penalties for violations related to security, public order, and social safety.
A warning or a fine ranging from 500,000 VND to 1,000,000 VND will be imposed for any of the following actions:
– Failure to comply with legal regulations regarding permanent residence registration, temporary residence registration, removal of permanent residence registration, removal of temporary residence registration, household separation, or adjustment of residence information in the National Residence Database, or providing inaccurate residence information;
– Failure to comply with legal regulations regarding stay notifications or temporary absence declarations;
– Failure to present residence-related documents or residence information on the National Identification Application upon request by authorized agencies or individuals.
A fine ranging from 2,000,000 VND to 4,000,000 VND will be imposed for any of the following actions:
– Altering or tampering with residence confirmation documents or other residence-related papers;
– Buying, selling, renting, or leasing residence confirmation documents or other residence-related papers for unlawful purposes;
– Borrowing, lending, or using residence confirmation documents or other residence-related papers for unlawful purposes;
– Failing to update residence registration after moving to a new legal residence that meets registration criteria;
– Failure by accommodation businesses, collective housing, healthcare facilities, tourist accommodations, industrial zone accommodations, and other establishments to report the stay of 1 to 3 individuals;
– Inciting, instigating, coercing, or facilitating others to violate residence laws;
– Pledging or accepting pledges of residence documents or materials;
– Destroying residence documents or materials.
A fine ranging from 4,000,000 VND to 8,000,000 VND will be imposed for any of the following actions:
– Allowing others to register residence at one’s own address for profit;
– Failure by accommodation businesses, collective housing, healthcare facilities, tourist accommodations, industrial zone accommodations, and other establishments to report the stay of 4 to 8 individuals;
– Obstructing citizens from exercising their right to freedom of residence;
– Obstructing or failing to comply with inspections related to permanent residence, temporary residence, stay notifications, temporary absence declarations, or residence checks as required by law.
A fine ranging from 8,000,000 VND to 12,000,000 VND will be imposed for any of the following actions:
– Providing false information, documents, or materials regarding residence for purposes such as permanent residence registration, temporary residence registration, residence information declaration, household separation, residence information adjustment in the National Residence Database, removal of permanent residence registration, removal of temporary residence registration, temporary residence extension, temporary absence declaration, issuance of other residence-related documents, or other unlawful activities;
– Fabricating or using fabricated residence data for purposes such as permanent residence registration, temporary residence registration, residence information declaration, household separation, residence information adjustment in the National Residence Database, removal of permanent residence registration, removal of temporary residence registration, temporary residence extension, temporary absence declaration, issuance of other residence-related documents, or other unlawful activities;
– Fabricating or using fabricated residence information on the National Identification Application;
– Failure by accommodation businesses, collective housing, healthcare facilities, tourist accommodations, industrial zone accommodations, and other establishments to report the stay of 9 or more individuals.
In addition to fines, confiscation of violating items and means will be applied for the following actions:
– Altering or tampering with residence confirmation documents or other residence-related papers;
– Destroying residence documents or materials;
– Providing false information, documents, or materials regarding residence for purposes such as permanent residence registration, temporary residence registration, residence information declaration, household separation, residence information adjustment in the National Residence Database, removal of permanent residence registration, removal of temporary residence registration, temporary residence extension, temporary absence declaration, issuance of other residence-related documents, or other unlawful activities;
– Fabricating or using fabricated residence data for purposes such as permanent residence registration, temporary residence registration, residence information declaration, household separation, residence information adjustment in the National Residence Database, removal of permanent residence registration, removal of temporary residence registration, temporary residence extension, temporary absence declaration, issuance of other residence-related documents, or other unlawful activities;
– Fabricating or using fabricated residence information on the National Identification Application.
Additionally, any unlawful profits gained from buying, selling, renting, or leasing residence confirmation documents or other residence-related papers; pledging or accepting pledges of residence documents or materials; or allowing others to register residence at one’s own address for profit must be surrendered.
