On February 19th, the Office of the President held a press conference to announce the promulgation of the amended Land Law, which was passed by the National Assembly during its 5th extraordinary session.
According to Mr. Le Minh Ngan, Deputy Minister of Natural Resources and Environment (NRE), land without documentation will be granted land use right certificates (red books) if they meet the conditions specified in Article 138 Clause 3 of the Land Law 2024.
Households and individuals that have been using land from October 15, 1993, to before July 1, 2014, without documentation on land use rights and without violating land laws, and if the land was not allocated outside of the authorized jurisdiction, will be granted red books if they meet the conditions and if they are confirmed by the People’s Committee at the commune level to be free from disputes.
Mr. Le Minh Ngan stated that this regulation was included in the law based on practical foundations and met the requirements for land management. The Deputy Minister of NRE emphasized the requirement of “no disputes” when granting red books.
To implement this, Mr. Le Minh Ngan mentioned the important role of land management officers at the local level, as they have a clear understanding of land changes, land use conditions, and whether there are any disputes or not.
When asked by the press about how to facilitate the procedures for granting red books to land without documentation, Deputy Minister Le Minh Ngan stated that the regulation in the law is just the first step, and the implementation process is crucial. In addition, the compliance with the law by the citizens is also important.
Regarding the requirement to determine land without disputes, Mr. Ngan said that the local authorities need to carefully consider this matter. In the future, the NRE will draft a Decree which will include provisions on the procedure for granting red books to land without documentation, in order to minimize inconvenience for the citizens.
“Furthermore, the citizens need to enhance their compliance with the law and propose appropriate red book applications in accordance with the regulations and policies,” Mr. Le Minh Ngan emphasized.
The Land Law will come into effect on January 1, 2025.
