Dong A Group sues Thanh Hoa City’s People’s Committee for land dispute

The Thanh Hoa Provincial Court recently announced the handling of a case involving an administrative dispute between the plaintiff, Dong A Group Limited Liability Company (Dong A Group), represented by Mr. Cao Tien Doan, CEO, located at 1A Nguyen Hieu, Le Loi Boulevard, Dong Huong Ward, Thanh Hoa City, and the defendant, Thanh Hoa City People's Committee, with the related rights and obligations held by Thanh Hoa Provincial People's Committee.

Specifically, Dong A Group has submitted a request to the court: Compel the People’s Committee of Thanh Hoa City to carry out the directives of the Provincial People’s Committee in the announcement of conclusion no. 69/TB-UBND dated 4/9/2019 and announcement no. 133/TB-UBND dated 6/24/2019; implement the land clearance, complete the infrastructure of the planned area number 731/QD-UBND dated 1/22/2020; compel the People’s Committee of Thanh Hoa City to hand over 196 resettlement lots equivalent to 3.5 hectares of land in the planned area number 731/QD-UBND dated 1/22/2020 to Dong A Group.

It is known that immediately after submitting the lawsuit to the Provincial People’s Court of Thanh Hoa, Dong A Group has sent a document to the Chairman of the Provincial People’s Committee. The document states: Up to now, it has been 4 years and 2 months since the Chairman of the Provincial People’s Committee agreed to return 196 commercial land lots to Dong A Group, in place of the withdrawal of 194 land lots equivalent to over 15,721m2 by the People’s Committee of Thanh Hoa City, for Dong A Group…

Thanh Hoa City has been tardy in land clearance work and handing over land funds for the investor to recover capital according to the directives of the Chairman of the Provincial People’s Committee. Thus, the People’s Committee of Thanh Hoa City has not strictly carried out the directives of the Chairman of the Provincial People’s Committee.

Therefore, Dong A Group has officially filed a lawsuit to sue the administrative act of the People’s Committee of Thanh Hoa City. “Dong A Group respectfully informs the Chairman of the Provincial People’s Committee of Thanh Hoa and requests guidance to remove difficulties and obstacles for businesses, so that the People’s Committee of Thanh Hoa City can soon hand over the land funds in the planned area 731 to Dong A Group for utilization,” states the document of Dong A Group.

On 2/22, after receiving the document from Dong A Group, the Chairman of the Provincial People’s Committee of Thanh Hoa assigned the People’s Committee of Thanh Hoa City to study and respond in writing to the difficulties, obstacles, and recommendations reported by Dong A Group. During the implementation process, if there are any obstacles, the People’s Committee of Thanh Hoa City shall actively seek guidance and consult (or hold conferences) with relevant departments and branches to obtain instructions for resolution according to their authority.
