The 2024 Land Law consists of 16 chapters, 260 articles, which revise and supplement 180/212 articles of the 2013 Land Law and add 78 new articles.
The new Land Law has divided the groups granted land use certificates for land without documents into 3 groups, including:
– Households, individuals using land before December 18, 1980, now being issued by the People’s Committee of the commune where the land is confirmed not to be in dispute;
– Households, individuals using land from December 18, 1980, to October 15, 1993, now being issued by the People’s Committee of the commune where the land is confirmed not to be in dispute;
– Households, individuals using land from October 15, 1993, to July 1, 2014, now being issued by the People’s Committee of the commune where the land is confirmed not to be in dispute.
The common point of these 3 groups is that they all must be issued by the People’s Committee of the commune where the land is confirmed to be dispute-free, not to violate the land laws, not to be handed over inappropriately, in accordance with the land use planning, and depending on each group, there will be specific regulations on granting land use certificates.
Regarding the recognition period for land use rights for land without documents currently being used by individuals, stable family households, according to the new Law, will be extended for an additional 10 years compared to the previous regulations.
In addition, the Law also stipulates that households, individuals who are assigned agricultural land, have used it for residential purposes, non-agricultural land before July 1, 2014, without the required documents, have registered their permanent residence at the local place, are in the area with difficult socio-economic conditions, especially difficult conditions, being issued by the People’s Committee of the commune where the land is confirmed not to be in dispute, in accordance with the land use planning, will be granted land use certificates, ownership rights attached to the land and no land use fees are required.
Furthermore, households, individuals who are currently using land stably for agricultural purposes, now being issued by the People’s Committee of the commune where the land is confirmed not to be in dispute, will be granted land use certificates, ownership rights attached to the land under the form of the State granting the land without land use fees for the area of land being used, but not exceeding the land allocation limit for individuals as regulated.
The term of land use, ownership rights attached to the land is calculated from the date of issuance of the land use certificate. For the remaining agricultural land (if any), it must be converted to lease land from the State.
The 2024 Land Law will come into effect from January 1, 2025.
