Series of serious violations
The Bắc Ninh provincial inspectorate
has just issued Concluding the inspection No. 11 on the inspection of the Investment Project for Construction
, business of the VSIP Bac Ninh Urban and Service Area, invested by De Tam Joint Stock Company (De Tam JSC). Accordingly, this provincial inspectorate pointed out many existing and violations during the project implementation process.
Specifically, De Tam JSC is the investor that has been transferred a part of the Investment Project for Construction, Business of the Urban and
Service Area VSIP
Bac Ninh by Bac Ninh VSIP Company Limited.
In Decision No. 18 dated January 13, 2022 on approving the adjustment of investment policy and approving investors, determining the progress of completing construction works on land in 2021.
However, the project has not been completed yet, transferred for use. The investor has also not adjusted the investment progress of the project in accordance with regulations.
In particular,
Bac Ninh VSIP Company Limited
signed a contract to transfer a part of the
Urban Area
and VSIP Bac Ninh service project to De Tam JSC when there was no consent document from the Chairman of the Bac Ninh Provincial People’s Committee. In addition, Bac Ninh VSIP Company has transferred 1,000 m2 of land to De Tam JSC before the Bac Ninh Provincial People’s Committee has decided to revoke the land and transfer the land in accordance with the 2013 Land Law.
At the same time, the Bac Ninh provincial inspectorate also discovered that some minutes of project acceptance for construction work were not listed in the participants in the acceptance but were signed without clearly stating their full names. Typically, the minutes of construction work acceptance No. 37/BBNT-DTA dated January 23, 2022, belong to the Quality Management File. All the acceptance of infrastructure has mistakenly recorded the acceptance location.
In fact, the project is located in the VSIP Bắc Ninh Urban Area, but the acceptance record for construction work is in Nhơn Trạch. No requirement to establish, approve occupational safety and environmental protection measures for items during the construction process.
Notably, the inspection team recalculated on the Investment Project file of the construction design drawing provided by the investor, with a total difference reduced by VND 10,319 million.
Regarding
real estate business conditions
, the inspection conclusion determined that in 2019 De Tam JSC signed 27 principle contracts in the form of capital mobilization to register, enjoy the right to purchase land lots in the project for the mobilizing party, while there was no announcement of the conditions for capital mobilization of the Department of Construction, violating the provisions of the Housing Law.
Strict handling
From the above violations, the Bac Ninh provincial inspectorate proposed the Department of Construction to inspect and handle
De Tam JSC
in signing 27 contracts for capital mobilization when there was no Announcement of the conditions for capital mobilization by the Department of Construction.
The provincial inspectorate requested the People’s Committee of Tu Son Town to direct relevant agencies to review, inspect and handle administrative violations for the construction order violations that the inspection team has pointed out. For contents exceeding authority, propose the People’s Committee of Tu Son Town to prepare dossiers, propose competent authorities to handle according to regulations.
