Business Penalized with 350 Million VND Fine, Speak Up

The State Securities Commission has recently announced three penalties against businesses, all of which have violated information disclosure regulations. One of the businesses has been fined 350 million VND for failing to register securities trading and deliberately causing disturbances on the market.

CTCP Đầu tư xây dựng và Công nghệ Tiến Trung has been fined VND 125 million for 2 violations. Of this, VND 65 million is the penalty for failing to disclose information on time according to legal regulations regarding the separate and consolidated financial statements for the first, second, and fourth quarters of 2022, the separate and consolidated financial statements for 2021 that have been audited, the annual report for 2021, the semi-annual financial statements for 2022 that have been reviewed, the separate and consolidated financial statements for the second quarter of 2023, the half-year company governance report for 2023, and some other decisions.

The company was fined VND 60 million for not fully disclosing information according to legal regulations. In the audited financial statements for 2022, the company had transactions with related parties, including HT Group Hoa Binh JSC (Mr. Hoang Anh Quyet is the General Director of both companies). However, this information was not reflected in the company governance report for 2022.

All 3 companies were fined for violations in disclosing information.

CTCP Khoáng sản và Cơ khí has been fined VND 92.5 million for not disclosing information according to regulations regarding the following documents: financial statements for the first, second, and third quarters of 2021, the third quarter of 2022, the third and fourth quarters of 2023, the audited financial statements for 2022 and 2023, the annual resolutions and meeting minutes of the ordinary shareholders’ meeting for 2021, 2022, and 2023, the semi-annual financial statements for 2023 that have been reviewed, and the company governance report for 2023. CTCP Giải pháp thương mại A BA has been fined a total of VND 415 million for 2 violations. Of this, VND 350 million is the penalty for not registering securities trading. The company completed its registration as a public company on August 31, 2022, but has not yet registered stock trading on the stock trading system. In addition to the fine, the company must submit a registration dossier for securities trading to the Vietnam Stock Exchange and its subsidiary within a maximum of 60 days from the effective date of the penalty decision.
