In the afternoon of April 24th, the trial of the defendant Tran Qui Thanh and his two daughters entered the debate phase. Before the debate, the VKS representative presented the prosecution’s view of the case.

According to the VKS representative, the defendants Tran Qui Thanh, Tran Uyen Phuong, and Tran Ngoc Bich held management and executive roles in the company, having experience in business. However, to conceal the act of lending assets through a project transfer contract, the defendants and shareholders. The victims in the case suffered significant financial losses over an extended period.

The defendant Tran Qui Thanh was the one who directly worked with and exchanged information with the borrowers, then notified his two daughters, Tran Uyen Phuong and Tran Ngoc Bich, and should, therefore, bear the primary responsibility.

The VKS also acknowledged several mitigating circumstances for the defendant Thanh and his two daughters, such as their candid confessions, the creation of jobs for workers, contributions to the local economy, significant contributions to the prevention of the Covid-19 epidemic, and numerous awards.

However, the fact that the defendant had committed the crime on two or more occasions was considered an aggravating circumstance.

Based on these arguments, the VKS representative requested that the People’s Court sentence the defendant Tran Qui Thanh to 9-10 years in prison, Tran Uyen Phuong to 5-6 years in prison, and the defendant Tran Ngoc Bich to 4-5 years in prison.

According to the indictment, through intermediaries, the three defendants, Tran Qui Thanh and his daughters, loaned Ms. Dang Thi Kim Oanh (Chairwoman of the Board of Directors of Kim Oanh Company) 500 billion VND by signing a disguised contract to transfer shares in Minh Thanh Company, agreeing to transfer the Nhon Thanh project to Tran Uyen Phuong, Tran Ngoc Bich, and TCS Company for an interest rate of 3%/month; a late payment penalty of 4.5%/month, covered up by a commitment to sell back.

When Ms. Kim Oanh’s side had prepared the full amount of 500 billion VND, Mr. Tran Qui Thanh’s side invoked reasons for violating the terms of the contract and, therefore, lost the right to repurchase. The value of the misappropriated Minh Thanh project was determined to be over 427 billion VND, and the Nhon Thanh project was over 453 billion VND.
