Local Firm Occupying 5.4 Acres of Land Unexpectedly Disputes Decision of Binh Dinh Provincial Chairman

A Binh Duong-based company that has illegally occupied 2.2 hectares of land in Quy Nhon City for many years as an unauthorized parking lot suddenly sent a document protesting the decision of the Chairman of the Binh Dinh Provincial People's Committee.

On April 26th morning, information from the Office of the Binh Dinh Provincial People’s Committee stated that the Chairman of the Provincial People’s Committee had just issued a document regarding the consideration and resolution of the petitions of Quy Nhon Highway Management and Repair JSC (abbreviated as Quy Nhon Highway Company, headquartered in Quy Nhon City) related to the parking lot at plot A3, Dien Bien Phu Street, Nhon Binh Ward, Quy Nhon City.

Plot A3 has been illegally occupied by Quy Nhon Highway Company for parking business for 4 years

Accordingly, the Chairman of the Binh Dinh Provincial People’s Committee assigned the Department of Natural Resources and Environment (TN-MT) to preside over and coordinate with related units to review the contents of the petitions of Quy Nhon Highway Company. Thereby reporting and proposing to the Binh Dinh Provincial People’s Committee before May 10th.

Related to the above incident, Nguoi Lao Dong Newspaper has published a series of articles reflecting the act of arbitrarily occupying plot A3 with an area of approximately 2.2 hectares for illegal parking by Quy Nhon Highway Company.

Specifically, Quy Nhon Highway Company arbitrarily leveled the ground and put plot A3 into use for paid parking services since more than 4 years ago without obtaining a license or land allocation from authorized agencies. It is estimated that, with the parking lot rental service fee in Quy Nhon City, Quy Nhon Highway Company earns billions of VND each year without paying land rent.

After the reflection by Nguoi Lao Dong Newspaper, the Binh Dinh Provincial Department of Natural Resources and Environment sent a document requesting the People’s Committee of Quy Nhon City to require Quy Nhon Highway Company to dismantle and relocate all works and assets on the ground so that the state can auction the land use right at plot A3. 

In addition, the Chairman of the Binh Dinh Provincial People’s Committee also issued a document assigning the Provincial Tax Department to preside over and coordinate with the People’s Committee of Quy Nhon City and related competent agencies to review and collect financial obligations related to the use of plot A3 in accordance with regulations; also rejected the proposal of the People’s Committee of Quy Nhon City that the investor winning the auction of the project must refund the ground leveling cost of nearly 5.6 billion VND to Quy Nhon Highway Company.

After the reflection by Nguoi Lao Dong Newspaper, the advertising board for parking services erected by Quy Nhon Highway Company on plot A3 was dismantled, but in fact, parking fees were still collected inside.

Although the above documents were issued several months ago, up to now, Quy Nhon Highway Company has not yet dismantled or relocated all works and assets on plot A3 and continues to operate the paid parking service, leading to the fire on the night of April 20th that burned 4 tractor-trailers.

Not only that, recently, this Company also issued a document signed by Director Ha Bac Tuan, which contains quite a few contents refuting the decision of the Chairman of the Binh Dinh Provincial People’s Committee.

In the above document, Quy Nhon Highway Company stated that “the state assigned the project to the enterprise to do”, but in fact, up to this point, plot A3 has not yet been licensed or allocated land by any competent agency to any enterprise to carry out the project.

Not only that, Quy Nhon Highway Company also stated that over the years, the company has leveled and kept the land for the state. During this process, the company exploited the vehicle storage service, but it was only temporary, the main purpose was still to manage the assigned land. The revenue from the vehicle storage service has been fully declared and paid taxes by the company…

It is curious that in the document just sent to the Chairman of the Binh Dinh Provincial People’s Committee, the Quy Nhon City Party Secretary, the Quy Nhon City People’s Committee Chairman and the Head of the Quy Nhon City Tax Sub-department, Quy Nhon Highway Company did not specify the date.

Moreover, although the beginning of the document states “Submitted to the Chairman of the Binh Dinh Provincial People’s Committee”, but at the end of the document, the Company only “respectfully requests” the Quy Nhon City Party Secretary, the Quy Nhon City People’s Committee Chairman and the Head of the Quy Nhon City Tax Sub-department to “resolve” and did not mention the Chairman of the Binh Dinh Provincial People’s Committee.
