Which areas in Binh Duong are not subject to land subdivision and sale restrictions?

Currently, Binh Duong is the locality with the most cities in the country, with 5 cities. These 5 special areas will not be divided into plots and sold according to the provisions of the Law on Real Estate Business (amended), which took effect on January 1, 2025.

The amended Law on Real Estate Business (taking effect in 2025) stipulates that the right to use land in wards, districts, and cities of special, type I, II and III urban areas and in the case of auctioning the right to use land to invest in housing construction projects under the provisions of the Land Law, cannot be transferred to individuals for self-construction of houses, self-divided and subdivided land for sale in the ground.

For the remaining areas, the provincial-level People’s Committee shall, based on local conditions, determine the areas where project investors are allowed to transfer the right to use land with technical infrastructure to individuals for self-construction of houses.

Accordingly, Binh Duong province has 1 type I urban area, 1 type II urban area, and 3 type III urban areas which are not allowed to be divided and sold.

Specifically, Thu Dau Mot City is the political, administrative, economic and cultural center of Binh Duong province, the Prime Minister signed the Decision to recognize Thu Dau Mot city as a type I city under Binh Duong province in December 2017. This will be an area where it is not allowed to divide and sell the land.

Di An City is a type II city under Binh Duong province . Di An officially became a city from April 2020 and became a type II city on March 27, 2023.

Tp . Thuan An is a type III city under Binh Duong province, which is also not allowed to be divided and sold.

The remaining two areas in Binh Duong are Tp . Tan Uyen and Ben Cat town are two type III cities under Binh Duong province that will not be divided and sold from January 2025. Ben Cat will officially become the 5th city of Binh Duong on May 1, 2024.

Thus, this province only has Phu Giao district and Dau Tieng district as the 2 areas allowed to be divided and sold according to the provisions of the amended Law on Real Estate Business that took effect on January 1, 2025.
