17 Houses Built in Violation of Planning Regulations in Lam Dong Province
On April 25, the Lam Dong Department of Construction received a document from the Inspectorate of the Ministry of Construction requesting information regarding 17 houses built in violation of planning regulations in Hamlet 10A, Loc Thanh Commune, Bao Lam District.
The Inspectorate of the Ministry of Construction has requested a detailed written report on the issues raised in the media, as well as any actions taken to address the violations (if any), and supporting documentation related to the housing development.
This report must be submitted to the Inspectorate of the Ministry of Construction by May 3, so that the Inspectorate can provide a report to the leadership of the Ministry of Construction.
For nearly a year, local residents have been reporting the illegal construction on a hill in Hamlet 10A, but the relevant authorities have not taken decisive action. To date, 22 terraced houses have been built on the hill, of which 17 are near completion, one has a steel frame, and four have completed foundation work.
After reviewing and comparing the relevant documents, the authorities have determined that the location of the terraced housing development does not comply with the land use plan and construction plan. Based on legal regulations, the housing development is not in accordance with the Law on Construction and the Law on Housing. Notably, the relevant authorities have not yet imposed any administrative sanctions on the offending structures.
On April 3, the Bao Lam District People’s Committee issued decisions to temporarily suspend the work of Do Ngoc Can, Chairman of the Loc Thanh Commune People’s Committee, and Tran Ngoc Hoan, administrative officer for land, agriculture, construction, and environment in the commune, to investigate their responsibilities in allowing the construction of the 22 houses.
As reported by the Tien Phong newspaper, on April 22, the Lam Dong Provincial People’s Committee issued a document instructing the Bao Lam District People’s Committee to address the violations in the housing development in Hamlet 10A.
The Bao Lam District People’s Committee must clearly identify the violations, prepare a case file, and initiate administrative proceedings for the construction of the houses in accordance with the regulations of the Government and relevant laws; and resolve any consequences in accordance with legal regulations.
The Lam Dong Provincial People’s Committee has also instructed the District People’s Committee to carry out a review, take appropriate disciplinary action against the leadership of the Loc Thanh Commune People’s Committee, and any other organizations and individuals involved in construction management in the locality for allowing the aforementioned situation to occur, in accordance with regulations; and report the results by May 2.
At the same time, the District People’s Committee will continue to review, prepare, assess, and approve, or submit for approval by the competent authorities, various planning documents in the area to ensure consistency and coordination between the various levels of planning; and address the situation of overlap and inconsistency between land use plans, construction plans, urban plans, and detailed plans for rural settlements.
