Driving License Suspended from June 1 for Lending to Others!

The Minister of Transport recently issued Circular 05/2024/TT-BGTVT, amending the Circular related to road transport, road transport support services, vehicles, and drivers.

Clause 14 of Article 4 of the Circular specifically stipulates the cases in which a driving license (GPLX) will be revoked, as follows:

1. Drivers who commit fraud to obtain a driving license;

2. Drivers who erase, delete, or alter information on their driving license;

3. Allowing others to use their driving license;

4. Authorities issuing licenses to ineligible individuals;

5. Errors in information such as name, date of birth, nationality, residence, driving license class, validity, passing date, or signatory;

6. Medical examinations conducted by competent authorities determine the presence of drugs in the driver’s body (excluding actions subject to regulations in points c and d, Clause 10, Article 5; points h and i, Clause 8, Decree 100/2019/ND-CP).

Driving licenses revoked under the new regulations will be subject to specific penalties depending on the individual violation.

Under current regulations, Clause 2, Article 8 of Circular 12/2017/TT-BGTVT stipulates that individuals seeking driving licenses for classes B2, C, D, E, and F must undergo concentrated training at authorized training institutions and obtain elementary certificates or training certificates. Within one year from the date of completion of the training and assessment by the training institution, if the elementary certificate or training certificate is not obtained, the individual must undergo training again through a new course.

However, in point a, Clause 4, Article 4 of Circular 05/2024/TT-BGTVT, this provision has been amended. Individuals seeking driving licenses for classes B2, C, D, E, and F can choose to study theory through the following methods: concentrated training at a training institution; concentrated training at a training institution combined with distance learning, self-study with guidance; distance learning, self-study with guidance. However, for subjects such as vehicle structure and general repairs, fire prevention, firefighting, rescue, and first aid, and driving techniques, concentrated learning at a training institution is required.

The Ministry of Transport’s Circular also specifies that driving practice at night is defined as the period from 6 pm the previous day to 5 am the following day.

The new Circular takes effect from June 1, 2024.
