Ms. Duong’s civil lawsuit for compensation may cause overlap and conflict with the ongoing criminal proceedings. Sacombank has repeatedly petitioned and provided documentation to the Cam Ranh People’s Court in Khanh Hoa province to request a temporary suspension of the civil case with Ms. Duong, pending the outcome of the criminal case. However, the court proceeded with the trial. As a result, Sacombank will continue to appeal to the higher court to protect its legitimate rights.
Regarding the criminal case of embezzlement at the Cam Ranh Branch (Khanh Hoa Province), Sacombank proactively reported the incident to the State Bank’s Khanh Hoa Branch and submitted the case to the Provincial Police Investigation Agency in October 2022 for investigation and prosecution to ensure strict handling of violations and protect customers’ rights. For customers whose funds were misappropriated and who had no personal borrowing relationship or transaction signatures with the suspects, Sacombank immediately compensated for their entire loss after the incident was discovered. In the case of Ms. Ho Thi Thuy Duong, due to certain irregularities, Sacombank followed the investigation agency’s instructions and submitted the case to clarify the nature of the incident. The bank also committed to fulfilling its obligations after the conclusion of the competent authorities. During the waiting period, Sacombank met with Ms. Duong several times to seek solutions to alleviate her difficulties according to her wishes. The bank agreed to temporarily disburse VND 20 billion to support her business operations and stabilize her life while awaiting the investigation’s outcome. In November 2023, the Khanh Hoa Provincial Police Investigation Agency issued the Investigation Conclusion of the case, proposing the prosecution of the related accused. The conclusion stated that the accused had used various tricks to withdraw money from customers’ accounts at Sacombank, causing a loss of more than VND 17 billion to the bank.
