Comprehensive Land Audit and Evaluation for Enhanced Management and Efficient Land Use in Vietnam

In accordance with the Land Law and the National Statistical Survey Program issued under Decision No. 03/2023/QD-TTg dated February 15, 2023, the Prime Minister has instructed the Ministry of Natural Resources and Environment, relevant ministries, and the People’s Committees of provinces and centrally-run cities to conduct a nationwide land audit for 2024.

Quantifying Land Management and Utilization Status:

The primary objective of the 2024 land audit is to quantify the status of land management and utilization at the commune, district, and provincial levels, across socio-economic regions, and the entire country. This audit will evaluate land management practices, propose policies and measures to strengthen land governance, and enhance land use efficiency. It will also provide statistical indicators for the national statistical system and support various socio-economic activities, national defense, security, scientific research, education, and other state and societal needs.

The land audit must be conducted with utmost seriousness, comprehensiveness, and accuracy, adhering to the provisions of land-related laws. Ensuring objectivity and honesty, the audit will reflect the actual status of land use.

Scope of the 2024 Land Audit:

The land audit for 2024 will encompass the following for each administrative unit:

– Area of different types of land as per regulations, including land under the management of organizations and individuals as specified in Articles 6 and 7 of the 2024 Land Law;

– Status of management and utilization of golf course land, airports, areas prone to erosion and accretion, land originating from agricultural and forestry farms, and other specialized topics.

The audit will evaluate land management and utilization practices, analyze land use changes over the past five years at local and national levels, assess compliance with land use planning and regulations by organizations and individuals, identify limitations and challenges, and propose measures to enhance land management and efficient land use.

Nationwide Implementation from August 1, 2024:

The 2024 land audit will be conducted uniformly across the country, commencing on August 1, 2024. The audit data will be calculated up to December 31, 2024.

The deadlines for completing and reporting the land audit results are as follows:

– People’s Committees of provincial levels will determine the timeline for completing and submitting the land audit results for the commune and district levels;

– Provincial level completion by June 30, 2025;

– The Ministry of Defense and the Ministry of Public Security will complete and submit their results to the provincial People’s Committees by March 31, 2025, for compilation and reporting. They will also send their results to the Ministry of Natural Resources and Environment by June 30, 2025;

– The finalization and announcement of the 2024 land audit results will be completed by September 30, 2025.

The funding for the 2024 land audit will be allocated according to the Law on State Budget and other legal capital sources. The central budget will cover the tasks performed by ministries and central agencies, while local budgets will fund the tasks executed by provincial, district, and commune levels as per the current Law on State Budget regulations.
