The People’s Committee of Ho Chi Minh City has issued a directive to the Department of Natural Resources and Environment, the People’s Committees of districts and Thu Duc City (district-level People’s Committees), and the City Land Registration Office regarding the implementation of the 2024 Land Law.

This directive aims to ensure the timely enforcement of the provisions of the 2024 Land Law, along with its corresponding decrees: Decree 101/2024 on basic land investigations, land registration, the issuance of land use right certificates and ownership certificates for assets attached to land, and the land information system; and Decree 102/2024, which details and guides the implementation of the 2024 Land Law.

The directive also seeks to minimize disruptions in the process of receiving and returning results for procedures related to land and asset registration.

Ho Chi Minh City People’s Committee Directs Implementation of 2024 Land Law

Directives for Ho Chi Minh City Departments and Local Governments:

For procedures with changes in authority and procedure, the Receipt and Return Units of the district-level People’s Committees shall receive dossiers from domestic individuals, overseas Vietnamese retaining Vietnamese citizenship, and community households for four procedures:

  1. Initial registration and issuance of land use right certificates.
  2. Redetermination of land area for households and individuals who have already been granted certificates.
  3. Rectification of errors in initially issued certificates.
  4. Revocation and cancellation of initially granted certificates.

District-level People’s Committees are to organize the receipt, processing, and return of results in accordance with the proper inter-agency coordination mechanism. They are also responsible for assigning personnel with relevant expertise and qualifications to work in the Receipt and Return Units.

For procedures with no changes in authority, the branches of the Land Registration Office shall continue to receive dossiers from households, individuals, community households, and overseas Vietnamese who are allowed to own houses attached to land use rights in Vietnam. This applies to registration and certificate issuance procedures involving changes, except in cases of transfer of land use rights or purchase of houses and construction works in real estate development projects.

The Land Registration Office branches shall assign personnel to the Receipt and Return Units at the offices of the district-level People’s Committees. For branches with separate headquarters, they shall organize the receipt of dossiers and the return of results at their respective branches, as per regulations.

The Receipt and Return Unit of the Department of Natural Resources and Environment shall be responsible for receiving dossiers from organizations currently using land for the procedure of initial registration and issuance of land use right certificates, as well as rectification, revocation, and cancellation of initially issued certificates.

The Receipt and Return Unit of the City Land Registration Office shall receive dossiers for the following procedures:

  1. Initial registration and issuance of land use right certificates, rectification, revocation, and cancellation of initially issued certificates for overseas Vietnamese with Vietnamese origins.
  2. Registration and issuance of certificates due to changes for organizations and overseas Vietnamese with Vietnamese origins.
  3. Registration and issuance of certificates for individuals receiving transfers of land use rights or purchasing houses and construction works in real estate development projects.
  4. Rectification and revocation of certificates that have undergone procedures for changes in land and assets attached to land for organizations and overseas Vietnamese with Vietnamese origins.

Reporting Obstacles in Implementing the 2024 Land Law to the Ho Chi Minh City People’s Committee

Regarding the procedures for land and asset registration, the Ho Chi Minh City People’s Committee assigns the Department of Natural Resources and Environment, district-level People’s Committees, the City Land Registration Office, and its branches to proactively study and implement the provisions of the 2024 Land Law and its corresponding decrees (Decree 101 and Decree 102) when handling land and asset registration procedures.

The Department of Natural Resources and Environment is requested to urgently advise the Ho Chi Minh City People’s Committee on specific decisions regarding the contents of Clause 6, Article 21 of Decree 101. They are also responsible for guiding and consolidating the difficulties and obstacles faced by district-level People’s Committees and the City Land Registration Office in implementing the 2024 Land Law.
