On the afternoon of August 7, at the Government Headquarters, Prime Minister Pham Minh Chinh, Head of the Steering Committee for reviewing and handling obstacles in the system of legal documents, chaired a meeting of the Steering Committee.
Also attending the meeting were Deputy Prime Minister and Minister of Justice Le Thanh Long, Standing Vice Head of the Steering Committee; Minister and Chairman of the Government Office Tran Van Son, Deputy Head; Minister of Planning and Investment Nguyen Chi Dung, Deputy Head; leaders of ministries, sectors, and Government agencies, committees of the National Assembly, and the Vietnam Chamber of Commerce and Industry (VCCI) as members of the Steering Committee.
According to Decision No. 603/QD-TTg dated July 8, 2024, of the Prime Minister on the establishment of the Steering Committee, the Steering Committee has the function of assisting the Prime Minister in researching, directing, coordinating, reviewing, and handling obstacles in the system of legal documents.
After the establishment of the Steering Committee, on the same day, July 8, 2024, the Government’s Standing Committee and the Steering Committee held the first meeting to identify key tasks and solutions, including specific tasks for the Ministry of Justice (the Standing Agency of the Steering Committee) and ministries, sectors, and localities to focus on.
According to the Ministry of Justice, up to now, reports from 15 ministries and ministerial-level agencies, 55 localities, and a number of associations and enterprises on the review of legal documents have been received; along with 594 recommendations for 13 laws.
Based on the review, the Ministry of Justice and the assisting group of the Steering Committee have synthesized and classified the urgent problems and inadequacies that need to be handled in these 13 laws to remove difficulties and bottlenecks to promote growth, control inflation, and stabilize the macro-economy in the current context.
These include the Law on Investment with 4 groups of contents; the Law on Public Investment with 7 groups of contents; the Law on Investment in the form of Public-Private Partnership (PPP Law) with 5 groups of contents; the Enterprise Law with 1 content; the Law on Planning and the Law Amending and Supplementing a Number of Articles of 37 Laws related to planning with 10 groups of contents; the Law on State Budget with 5 groups of contents; the Law on Tax Administration with 5 groups of contents; the Law on Management and Use of Public Assets with 9 groups of contents; the Accounting Law with 7 groups of contents; the Law on National Reserves with 2 groups of contents; the Law on Independent Audit with 7 groups of contents; and the Securities Law with 8 groups of contents.
After listening to the opinions, Prime Minister Pham Minh Chinh acknowledged and appreciated the Ministry of Justice (the Standing Agency of the Steering Committee) for its timely coordination with ministries, sectors, and localities to proactively organize and implement activities according to the assigned tasks; and thanked the National Assembly and the agencies of the National Assembly for their determination and companionship with the Government and the Government’s agencies in reviewing and removing legal obstacles.
The Prime Minister basically agreed with the prepared documents and highly appreciated the opinions at the meeting; assigning the Standing Agency of the Steering Committee to coordinate with ministries, sectors, and localities to synthesize reasonable opinions and continue to improve the documents and prepare for the next meeting of the Steering Committee.
The Prime Minister clarified the guiding viewpoint that the review and handling of obstacles in the system of legal documents must be based on reality, respect reality, closely follow reality, and take reality as a measure. What is mature, clear, and proven by reality to be effective and agreed upon by the majority should be continued and legalized.
Removing obstacles contributes to the further improvement of the legal system in the spirit of inheriting and developing, adjusting and supplementing, learning and drawing lessons along the way, without being perfectionist or hasty, and tackling easy tasks before difficult ones. Putting people and businesses at the center and as the subject, creating breakthroughs, and removing difficulties for people and businesses.
According to the Prime Minister, the scope and subjects are urgent obstacles that need to be handled and removed to contribute to macroeconomic stabilization, control of inflation, promotion of growth, ensuring the major balances of the economy, creating jobs and livelihoods for the people, unblocking and effectively using all resources for development, with public investment and state resources leading and activating other legal resources; while focusing on key issues without being scattered.
The Prime Minister emphasized the principle of reviewing and handling, focusing on urgent issues that are truly necessary, creating breakthroughs based on careful, conscientious, and objective impact assessments; promoting decentralization and empowerment in tandem with resource allocation, enhancing implementation capacity associated with the design of tools to strengthen inspection and supervision; reducing administrative procedures, red tape, harassment, and preventing corruption and negativity.
Regarding the legal obstacles of the 13 laws as reported by the Ministry of Justice, the Prime Minister assigned the Ministry of Planning and Investment to coordinate with relevant agencies to urgently research and develop a project to amend multiple laws in the field of state management of the Ministry of Planning and Investment. The Ministry of Finance was assigned to coordinate with relevant agencies to urgently research and develop a project to amend multiple laws in the field of state management of the Ministry of Finance.
The Ministry of Justice was assigned to coordinate and ensure the process and procedures for building the law projects in accordance with regulations. Ministries, sectors, and localities continue to review legal documents, propose and send them to the Ministry of Justice and relevant agencies for synthesis. Coordination should be done early and proactively with the agencies of the National Assembly, and experts and scientists should be consulted to create consensus on issues with differing opinions.
The Prime Minister requested the Ministry of Justice, the Ministry of Planning and Investment, the Ministry of Finance, and relevant agencies to make more efforts, show higher determination, and focus on maximizing human resources, physical facilities, and finances for this task. They should prepare thoroughly and strive to submit the above-mentioned law projects to the National Assembly for approval at the 8th session of the 15th National Assembly (in October 2024), ensuring high feasibility and effectiveness when the laws come into force.
