The Ministry of Construction has issued Circular No. 05/2024/TT-BXD to guide the implementation of the Law on Housing, including regulations on the construction of multi-story apartment buildings by individuals.
According to the Circular, individuals investing in the construction of apartment buildings with two or more floors and less than 20 apartments, with each floor designed and constructed to be rented, must meet the following requirements:
They must obtain a construction permit along with design documents that clearly specify the total number of apartments, the number of apartments on each floor, the construction area of each apartment, parking areas, and common areas on each floor and in the building.
In cases where a construction permit is not required, individuals must submit a written notice to the People’s Committee of the commune, ward, or town where the building is located before construction. This notice must include details such as the number of floors and apartments to be constructed, the floor area of each apartment, the total number of apartments in the building, parking areas, and common areas on each floor and in the building.
Individuals must construct the apartment building in strict accordance with the approved construction permit or the notice submitted to the communal-level People’s Committee.
The apartment building must also comply with fire prevention and control regulations as stipulated by law, meet fire safety standards for detached houses, and provide adequate road access for fire trucks to perform their duties. Additional requirements may be specified by the provincial-level People’s Committee.
The management and operation of multi-story apartment buildings shall adhere to the Regulations on the Management and Use of Condominiums issued by the Minister of Construction.
