On August 20, the Chairman of the People’s Committee of Tánh Linh District, Bình Thuận Province, signed a document requesting the Department of Economy and Infrastructure, the Department of Justice, the People’s Committee of Gia An Commune, and Mr. Cao Thanh Sang to develop an enforcement plan to demolish an illegal construction in Village 1, Gia An Commune, Tánh Linh District.
On March 15, 2022, the People’s Committee of Tánh Linh District issued Decision No. 31/QD-XPHC, imposing an administrative penalty on Mr. Cao Thanh Sang (residing in Village 1, Gia An Commune, Tánh Linh District) for organizing the construction of a building without a permit, which is required by regulations.
According to Decision No. 31/QD-XPHC, within 90 days from the date of issuance of the administrative violation decision, Mr. Cao Thanh Sang must complete the dossier requesting the competent authority to grant a construction permit as prescribed for the land area conforming to the planning.
However, even after the deadline, Mr. Cao Thanh Sang failed to complete the dossier requesting the competent authority to grant a construction permit as required and continued the violation by resuming construction.
On August 15, 2022, the People’s Committee of Tánh Linh District issued Document No. 1159/UBND-SX, requesting the voluntary demolition of the violating construction. However, the investor has not complied with the directions of the Chairman of the People’s Committee of Tánh Linh District.
Subsequently, on November 17, 2022, the People’s Committee of Tánh Linh District again issued Document No. 1773/UBND-SX, requesting the urgent voluntary demolition of the violating construction. However, as of now, Mr. Cao Thanh Sang has not complied with the regulations and has not demolished the violating construction.
Therefore, the Chairman of the People’s Committee of Tánh Linh District assigned the Department of Economy and Infrastructure to coordinate with the Department of Justice, relevant agencies, and the People’s Committee of Gia An Commune to develop an enforcement plan to demolish Mr. Cao Thanh Sang’s violating construction, to be completed before September 10.
Yesterday, on August 19, Mr. Phan Dương Cường, Director of the Bình Thuận Province Department of Construction, signed a document sent to the People’s Committee of Tánh Linh District, requesting the demolition of the violating construction belonging to Mr. Cao Thanh Sang, residing in Village 1, Gia An Commune.
Through inspections, the Bình Thuận Province Department of Construction found that Mr. Sang organized the construction of a building without a permit, was fined, but did not stop the construction and instead completed and put it into use, causing negative impacts on public opinion.
Consequently, the Bình Thuận Province Department of Construction requested the People’s Committee of Tánh Linh District to immediately organize the demolition of Mr. Cao Thanh Sang’s violating construction in accordance with regulations. At the same time, they requested the handling of responsibilities of organizations and individuals related to the above violations. The results of handling violations of construction order must be reported to the Bình Thuận Province Department of Construction before October 30.
Mr. Cao Thanh Sang’s house was built on a plot of several thousand square meters, with construction starting in 2022 but without a construction permit. It is known that the owner of this house is a well-known tycoon in the field of mineral exploitation in Bình Thuận.
