According to the Inspection Conclusion No. 263/KL-TTCP dated July 19, 2024, by the Government Inspectorate, in 2006, the People’s Committee of Gia Lai province retrieved over 600 hectares of land and handed it over to the An Khe – KaNak Hydropower Company for the construction project of the An Khe – KaNak Hydropower Plant. However, the People’s Committee did not require the enterprise to pay land rent.
As per the Government Inspectorate, although the An Khe-Kanak Hydropower Company was eligible for exemption from land rent, the enterprise did not submit any documents and hence, was not entitled to the exemption. The decision by the Gia Lai Tax Department to issue Decision No. 751/QD-CT dated July 24, 2017, exempting the company from land rent from August 2006 to December 2017 was contrary to regulations.
This decision potentially caused a loss of 12.4 billion VND to the state budget, including over 8.2 billion VND in taxes and 4.1 billion VND in late payment fines.
Regarding the investment project of Hoang Dieu-ASEAN School (with an area of 2.47 hectares at 39 Han Mac Tu, Tra Ba Ward, Pleiku City) by the ASEAN Community Cultural Education Development Joint Stock Company, the Government Inspectorate also discovered violations.
The assets on this land plot were public assets, valued at over 2.9 billion VND by the Gia Lai Department of Finance. However, in 2012, the People’s Committee of Gia Lai province agreed to sell it directly to the ASEAN Community Cultural Education Development Joint Stock Company and then leased the land without an auction.
This violated the regulations on arranging and handling state-owned houses and land. Additionally, the Gia Lai Tax Department also issued a decision to exempt taxes during the basic construction period for three years (from April 2013 to March 2016), which was contrary to the provisions.
Regarding these violations, the Government Inspectorate requested the competent authorities to inspect and handle them in accordance with the law and to remedy the consequences. If violations that cannot be remedied or show signs of criminal law violations are discovered, the case shall be transferred to the competent authorities for handling.
At the same time, the Government Inspectorate also requested the People’s Committee of Gia Lai province to take full responsibility for the decisions issued regarding the exemption of land rent in these projects.
