Proposal to Repeal Certain Decisions of the Prime Minister on Land

The Ministry of Finance has proposed repealing nine decisions of the Prime Minister related to land use and rent exemption, which are no longer aligned with the Land Law 2024.

According to the Ministry of Finance, the draft decision aims to terminate the legal validity of certain provisions that are inconsistent with the Land Law of 2024 and its guiding documents, which came into force on August 1, 2024. This move ensures transparency and coherence in the legal system.

  1. Decision No. 44/2010/QD-TTg dated June 10, 2010, on exempting land use fees and land rent for the construction of auxiliary works of national expressways.
  2. Decision No. 57/2010/QD-TTg dated September 17, 2010, on exempting land rent for projects constructing warehouses for storing 4 million tons of rice, corn, cold storage for seafood, fruits and vegetables, and temporary storage of coffee according to the planning.
  3. Decision No. 33/2011/QD-TTg dated June 10, 2011, on exempting land use fees for households of fishermen and riverine dwellers who relocate to resettlement areas.
  4. Decision No. 48/2012/QD-TTg dated November 1, 2012, amending and supplementing Decision No. 204/2005/QD-TTg dated August 15, 2005, on adjusting and supplementing the subjects and capital borrowing mechanism for housing construction under the program for constructing residential clusters and lines and houses in areas regularly flooded by the Mekong River Delta.
  5. Decision No. 11/2015/QD-TTg dated April 3, 2015, on exempting and reducing land use fees when recognizing land use rights, ownership of houses and other assets attached to land for households and individuals with land of residential origin assigned (granted) by incompetent authority before October 15, 1993, in areas with difficult socio-economic conditions, especially difficult, border and island areas.
  6. Decision No. 22/2020/QD-TTg dated August 10, 2020, on reducing land rent in 2020 for subjects affected by the COVID-19 epidemic according to Resolution No. 84/NQ-CP dated May 29, 2020.
  7. Decision No. 27/2021/QD-TTg dated September 25, 2021, on reducing land rent in 2021 for subjects affected by the COVID-19 epidemic.
  8. Decision No. 01/2023/QD-TTg dated January 31, 2023, on reducing land and water surface rent in 2022 for subjects affected by the COVID-19 epidemic.
  9. Decision No. 25/2023/QD-TTg dated January 3, 2023, on reducing land rent in 2023.
