Unlocking the Power of Land: Minister Đỗ Đức Duy’s Vision for Transformational Change

Minister of Natural Resources and Environment, Do Duc Duy, emphasized the importance of having the 2024 Land Law come into force soon. He urged every official to become a spokesperson to propagate and enforce the law effectively.

On the morning of September 5, Minister Do Duc Duy requested the leaders of the Departments of Natural Resources and Environment of 63 provinces and cities and units under the ministry to focus on disseminating four decrees detailing the implementation of the Land Law 2024; with a determination to bring the law’s breakthrough contents (such as basic land investigation, land use planning, land retrieval, compensation, support, resettlement, land allocation, land leasing, land price…) into life as soon as possible.

Issuing four important decrees detailing the implementation of the Land Law 2024

At the Conference on Disseminating the Decrees detailing the implementation of the Land Law 2024, held by the Ministry of Natural Resources and Environment on September 5, Minister Do Duc Duy emphasized that the Land Law 2024 was passed by the National Assembly on January 18, 2024, at the 5th Extraordinary Session (taking effect from January 1, 2025).

At the 7th session, the National Assembly passed the Law amending and supplementing a number of articles of the Land Law, Housing Law, Real Estate Business Law, and Law on Credit Institutions. Accordingly, the National Assembly resolved that the Land Law would take effect from August 1, 2024, to bring breakthrough contents into life as soon as possible, contributing to the goal of renewing and perfecting the institutions and policies, improving the efficiency and effectiveness of land management and use, and creating a driving force for the country to become a developed country with high income.

The Land Law 2024 details 96 contents, of which the Government has assigned the Ministry of Natural Resources and Environment to take the lead in consulting and detailing 86/96 contents, focusing on: basic land investigation; land use planning; land retrieval, compensation, support, and resettlement; land allocation, land leasing, and land use purpose conversion; land prices; land registration, land use right certification, and ownership of assets attached to land; land use regime; supervision, monitoring, and evaluation of land management and use; inspection, examination, and audit; resolution of disputes, complaints, denunciations, and handling of violations of land law…

To ensure the conditions for the Land Law 2024 to take effect from August 1, 2024 (five months earlier than planned), Mr. Duy said that in a short time, the Ministry of Natural Resources and Environment has actively and proactively coordinated with ministries, branches, and related agencies to build and submit to the Government for issuance four decrees detailing the implementation of the Land Law 2024, which took effect at the same time as the law.

The decrees include: Decree No. 71/2024/ND-CP on land prices; Decree No. 88/2024/ND-CP on compensation, support, and resettlement when the State retrieves land; Decree No. 101/2024/ND-CP on basic land investigation, registration, certification of land use rights, ownership of assets attached to land, and Land Information System; Decree No. 102/2024/ND-CP detailing the implementation of a number of articles of the Land Law. In addition, the Ministry of Natural Resources and Environment has also issued four circulars under its competence as assigned in the law.

“This is a result of the spirit and working attitude of perseverance, perseverance, dedication, and seriousness; the contribution of wisdom, intelligence, and responsibility of officials, civil servants, and public employees of the entire natural resources and environment sector from central to local. Through this, it contributes to the effective management and liberation of land resources, meeting the requirements of socio-economic development, ensuring national defense and security, and sustainable development in the period of industrialization and modernization of the country; contributing to the perfection of the socialist-oriented market economic institution in our country,” Mr. Duy emphasized.

Minister Do Duc Duy also noted that along with the provisions of the law, the contents of the guiding decrees have also covered most of the state management contents of land, which is an important legal basis for organizing the effective and sustainable management of land resources in localities.

Therefore, to bring the Land Law into life soon, ensuring uniformity, synchronization, effectiveness, and efficiency throughout the country, through the Conference on “Disseminating the Decrees detailing the implementation of the Land Law 2024”, Mr. Duy requested the rapporteurs assigned to present the decrees to ensure that they cover all contents; focusing on analyzing in detail the key contents, the new points directly related to the organization of implementation in the locality.

On that basis, the delegates (leaders of the Departments of Natural Resources and Environment in 63 provinces and cities across the country) attending the conference focused on listening, following, and thoroughly discussing the new points and unclear contents to achieve unanimity in perception, thereby improving the quality of organization and implementation in practice.

“After the conference, each official and leader of the Departments will become rapporteurs in their localities, continuing to propagate and guide the uniform implementation of the land-related legal provisions in the locality; At the same time, based on the provisions of the law and the decrees and circulars, promptly advise the People’s Councils and People’s Committees of provinces and centrally-run cities to promulgate full and timely legal documents within their competence, in unison with the decrees and circulars, ensuring a full legal basis for the implementation of the law in the locality,” Mr. Duy emphasized.

Next, Ms. Doan Thi Thanh My – Director of the Land Department, specifically introduced Decree No. 102/2024/ND-CP detailing the implementation of a number of articles of the Land Law; Mr. Pham Ngo Hieu, Deputy Director of the Department of Registration and Land Information Data, presented a report on Decree No. 101/2024/ND-CP on basic land investigation.

According to Ms. My, the Decree detailing the implementation of a number of articles of the Land Law consists of 10 Chapters and 113 Articles detailing 54 contents assigned in the law, ensuring that it takes effect at the same time as the Land Law. In which, this decree stipulates the determination of individuals directly producing agriculture; detailed regulations on land classification; land type determination; land support for ethnic minorities; land use planning…

Notably, in terms of land retrieval, Ms. My said that the Decree has guided the implementation of land retrieval cases for national defense and security purposes; socio-economic development for national and public benefits; land retrieval due to violations of land laws; land retrieval due to termination of land use as prescribed by law, voluntary return of land, threats to human life; coercion to perform mandatory land inventory decisions, land retrieval decisions, complaints about land retrieval decisions, and coercion decisions.

Also at the conference, the Ministry of Natural Resources and Environment sent a survey questionnaire for delegates to provide information on the situation of building and promulgating legal documents guiding the implementation of the law under the competence of the People’s Councils and People’s Committees of provinces and centrally-run cities. On that basis, the ministry will summarize and report to the Government to continue directing localities to implement the law./.
