The Ha Tinh People’s Court has recently opened a first-instance criminal trial to prosecute Le Viet Cuong, former Director of the Ha Tinh Public Finance Center, and his accomplices for “Violation of bidding regulations, causing serious consequences.”
According to the indictment, in implementing the Target Program for Education in Mountainous, Ethnic Minority, and Disadvantaged Areas, along with procurement packages, the Ha Tinh Public Finance and Consulting Center (Public Finance Center) under the Ha Tinh Department of Finance, was responsible for purchasing state assets in a centralized manner, including teaching and learning equipment for the Ha Tinh Department of Education and Training.
During the 2017-2020 period, the following enterprises participated in the bidding process: Hong Ha Commercial Joint Stock Company (Hong Ha Company), headquartered in Vinh City (Nghe An province); Van Xuan Joint Stock Company (Van Xuan Company), headquartered in Ha Tinh City (Ha Tinh province); and Phuong Anh Educational Equipment and Toy Limited Company (Phuong Anh Company), headquartered in Hanoi.
Additionally, AIC-Vietnam Investment and Valuation Joint Stock Company, headquartered in Hanoi, was selected by the Ha Tinh Public Finance Center as the designated consultant for price appraisal.
Between 2017 and 2019, these enterprises participated in eight bidding packages with the aim of winning the contracts. The accused, including Nguyen Thi Thanh Tam from Hong Ha Company, Nguyen Xuan Thien from P&T Investment Joint Stock Company (Hanoi), Le Viet Cuong, Dinh Quoc Tan from Ha Tinh Public Finance Center, Nguyen Thanh Trung, and Nguyen Hong Hai from Phuong Anh Company, colluded to manipulate the bidding process, violating regulations and causing serious consequences, resulting in a loss of over 5.8 billion VND to the state budget.
The investigation results also revealed that Phuong Anh Company evaded taxes related to tax declaration and obligations after executing three packages, causing a loss of more than 2.3 billion VND to the state budget.
To ensure their victory in the bidding process, these enterprises colluded, exchanged information, and borrowed the qualifications and capabilities of other companies to build their bids. They also participated in the bidding process with the knowledge that they did not meet the requirements set out in the invitation to bid, demonstrating their intention to manipulate the process.
The accused, including Nguyen Thi Thanh Tam, Nguyen Xuan Thien, Le Viet Cuong, Dinh Quoc Tan, Nguyen Thanh Trung, Pham Viet Anh Vu, and Nguyen Hong Hai, were found guilty of bid-rigging, disclosing and receiving invitation to bid documents before the official release date, and committing fraud in the bidding process, in violation of the prohibited acts in bidding.
Furthermore, through intermediary companies, the educational equipment was passed through multiple intermediary units, ultimately doubling the price of the equipment before it reached the Ha Tinh Department of Education and Training.
After the trial, the court sentenced Nguyen Thi Thanh Tam to five years in prison, Le Viet Cuong to four years in prison, Nguyen Xuan Thien to three years and six months in prison, and Dinh Quoc Tan to three years in prison. Pham Viet Anh Vu, Nguyen Hong Hai, and Nguyen Thi Bich Ngoc were each sentenced to 36 months of probation. Tran Thi Chau Giang received 24 months of probation, while Nguyen Thanh Tung and Nguyen Manh Hieu were given 18 months of probation, all for the charge of “Violation of bidding regulations, causing serious consequences.”
Nguyen Thanh Trung was sentenced to three years in prison for “Violation of bidding regulations, causing serious consequences” and one year and three months in prison for “Tax evasion,” resulting in a combined sentence of four years and three months in prison for both charges.
