The project spans over 2.3 hectares and was approved for detailed planning at a 1/500 scale in Decision No. 112/QD-UBND dated January 16, 2015. The goal is to construct and renovate old villas into a premium resort villa complex for business operations and to enhance the area’s landscape.

As per the adjusted plans, from now until the end of 2025, the project will continue to finalize procedures for adjustments to the detailed planning, obtain construction permits, and execute the remaining construction items.

Previously, according to the initial investment decision, the project was scheduled to be implemented from March 2015 to June 2018, comprising 26 resort villa constructions. However, during the execution, the investor constructed 12 villa blocks, including an area of violation measuring up to 4,782.6 square meters.

On April 21, 2023, the People’s Committee of Ward 9, Da Lat City, issued an administrative violation record and ordered a halt to the construction. Subsequently, on April 24, 2023, the Da Lat City People’s Committee issued a decision to fine Da Lat Five Star International Joint Stock Company VND 130 million for constructing without a permit and deviating from the design in land lots numbered 175, 176, 187, 570 on Map No. 22 and land lot number 79 on Map No. 26 (Nguyen Du Street, Ward 9).

At the beginning of 2024, the company submitted a request for an extension to rectify the consequences, committing to complete the procedures for obtaining a construction permit within 90 days. However, up to now, the company has only paid the fine and filled in the basement and foundation of some of the violating constructions; the completed structures have yet to obtain construction permits.

According to the Da Lat City People’s Committee, the Da Lat Five Star Happy Valley Villa Project, as part of an urban development project, is exempt from obtaining a construction permit as per Clause h, Article 89 of the 2014 Law on Construction, amended by Clause 30, Article 1 of the Amended Law on Construction 2020 (specifically, separate houses with a scale of less than 7 floors belonging to an investment project for construction of urban areas, investment projects for construction of houses with a detailed planning of 1/500 that has been approved by the competent state agency).
