Manulife Insurance Lawsuit: Court Dismisses Plaintiff’s Claims in Part

On September 22, the People’s Court of District 5, Ho Chi Minh City, held a trial for a lawsuit between Ms. D.P.D.L and Manulife Insurance Company Limited (Vietnam), regarding a dispute over a life insurance contract. Ms. L. authorized her lawyer to represent her in court.

According to the lawsuit, Ms. L. claimed that she was introduced to a high-interest investment savings program with free insurance by an SCB bank employee. During the application process, she learned it was a life insurance contract. Ms. L. argued that there were several legal violations and requested the court to declare the contract invalid. She had paid three installments to Manulife.

In court, Manulife’s representative stated that the consultation and signing process complied with legal regulations and the company’s internal procedures. Manulife submitted relevant documents, including the insurance application file signed by Ms. L., product terms, payment records, and other transaction details, as evidence of her willingness to participate in the insurance contract.

During the examination, Ms. L.’s lawyer argued that the contract violated legal provisions. Manulife’s representative countered that the contract terms were approved by the Ministry of Finance and complied with insurance laws. Ms. L. had a 21-day review period and confirmed her understanding of the contract’s terms and benefits by signing the acknowledgment. Manulife asserted full compliance with legal and procedural requirements.

After reviewing the case files and hearing arguments, the court ruled that there was no basis to invalidate the contract. Both parties had full civil capacity, and the agreement was made voluntarily. The court dismissed Ms. L.’s claims, upholding the contract’s validity.
